On 11/14/2024 at 9:50am, Licensing Program Analysts (LPAs) Oscar Picazo conducted an unannounced case management inspection for the purpose of an increase in capacity. Upon arrival, LPAs met with licensee, Widmaer Victorin and disclosed the purpose the inspection. The purpose of the inspection is to ensure that the home follows standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. Also present was Gordy Gaetan to provide translation in Haitian Creol. Days and hours of operation are Sunday through Saturday, 6:00am – 11:59pm. There were no children present at the day are during the inspection. The licensee stated 3 of the 6 daycare children enrolled are pending the day care packet, 1 was picked up early at 1:45 PM, and the other 2 children are at school.

On 10/11/2024, a fire clearance was granted for 14 children. LPAs, accompanied by applicant, toured the indoor and outdoor of the home. This is a single story 2-bedroom, 2-bathroom home. Licensee will utilize the following areas for childcare: the living room, dining room, bathroom #1 (hallway) and side patio area #1. Off limit areas include the Kitchen, the 2 bedrooms (#1 & 2), bathroom #2, patio area #2. Off limit areas are inaccessible to children by use of child proof doorknob covers, safety latches and cabinet locks. Applicant will utilize the fenced side patio #1 for outdoor activities. LPA informed applicant to ensure children are supervised at all times during outdoor activities. The licensee obtained and LPA viewed a signed Property Owner/Landlord Consent form (LIC 9149).



The fire extinguisher is rated 2-A:10-B:C which meets statutory requirements and is located in the kitchen. Smoke and carbon monoxide detectors meet requirements and are operational. Poisons, detergents, cleaning compounds, medications and other hazardous items were made inaccessible to children by cabinet latches/locks and/or placed on high surfaces. The applicant has a working cell phone. Licensee stated there are no bodies of water on the premises. LPA observed no bodies of water during the time of inspection. Licensee stated there are no firearms, other weapons, or ammunition in the home.

Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Licensee's Mandated Reporter AB1207 training expires on 02/28/2025. Pediatric CPR and First Aid certifications expire on 03/2025. A sample of children’s files were reviewed and were determined to be complete.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

On this date, 11/14/2024, the California Attorney General - Megan’s Law website (meganslaw.ca.gov) was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

LPA discussed with Licensee the maximum capacity for a Large Family Child Care home: 12 children (with a qualified assistant) with no more than 4 infants; or (with landlord consent) 14 children (with a qualified assistant) with no more than 3 infants, 1 child enrolled in kindergarten or elementary school and 1 child at least age 6 including children under age 10 who live in the licensee's home. When there is no qualified assistant, 14 years of age or present, the capacity reverts to the requirements for a Small Family Child Care.

A copy of the report and appeal rights (LIC 9058) was provided to the Licensee and notice of site visit (LIC9213) was given to Licensee and was advised it must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

No deficiencies were cited during this inspection.

A large family childcare home license may be issued upon final file review.

Exit interview was conducted with applicant, Widmaer Victorin. LPA O. Picazo read reviewed the report and Gordy Gaetan provided translation from English to Haitian Creol. Applicant stated he understood.
