On 08/05/2025 at 11:45AM Licensing Program Analyst (LPA), Saul Zazueta conducted an unannounced complaint inspection regarding the above allegation(s). Upon arrival, LPA met with Licensee Sofia Salazar Lopez, and discussed the purpose of the inspection, the complaint process and was led on a tour of the facility.

During the course of the investigation, LPA conducted interviews with the licensee, staff, daycare children, and daycare parents. Facility roster was obtained and reviewed by LPA.

It was alleged that on 05/02/2025, daycare child #9 (C9) was not accorded dignity by staff #2 (S2), when S2 physically mishandled C9. The licensee denied the allegation, stating that facility staff have a great relationship with daycare children and do not hit them. Based on an interview with S2, on 05/02/2025, they arrived at the facility after picking up children from school and opened the vehicle’s passenger door for C9. They stated that C9 then exited the vehicle and darted down the driveway towards a busy road, which S2 tried to prevent by grabbing a hold of them.

LPA reviewed surveillance camera footage of the incident and observed a failed attempt by S2 to grab a hold of C9, followed by a simulated kick in the direction of C9; however, the video contained no audio or context for the situation. Based on an interview with C9, although they did not remember the incident, they stated that they have not been made to feel afraid of S2 and did not mention ever being hit by them. Out of 11 children interviewed, there were no children that reported being hit by teachers. Parents interviewed had no concerns of children being treated without dignity by the staff.

It was also alleged that the licensee transports daycare children in an unsafe manner by exceeding the vehicle’s passenger capacity. The licensee denied the allegation, stating that their vehicle is equipped with enough seats for the number of children they pick up. According to the licensee, children are transported in an 8-passenger minivan and the number of children transported does not exceed the number of seats the vehicle has at any given time. Based on LPA observation of the vehicle, the maximum number of vehicle occupants is confirmed to be 8. Daycare children interviewed denied the allegation stating that children are always in a car seat or have a seat belt on during transport.

Based on interviews, observations and record review, it could not be determined that the licensee or staff members physically mishandle daycare children or provide transportation in an unsafe manner. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview was conducted and this report was reviewed with Licensee, Sofia Salazar Lopez. A Notice of Site Visit was provided and must remain posted for 30 days.
