32 | Based on the interviews conducted, and record review it was determined, that A1 did not obtain a criminal record clearance prior to their initial presence in the home. The allegation is valid because the preponderance of the evidence has been met, therefore, the allegation of an uncleared adult in the home is found to be substantiated.
It was also alleged that the licensee hit a daycare child. During the course of the investigation, interviews were conducted with the reporting parties, Licensee, 5 daycare children, daycare parents and a staff member (A1). During the investigation 5 daycare children were interviewed. 3 of those 5 children independently reported that the licensee "hit them" with her hand when they misbehaved. One daycare child reported that they observed the licensee hit another daycare child. Based on the consistency among multiple independent interviews the preponderance of evidence has been met, therefore, the allegation of licensee hit a child is found to be substantiated.
California Code of Regulations, Title 22, Division 12, Chapter 3, two deficiencies are being cited on the attached LIC 9099D. A $500 civil penalty is being assessed today, see LIC 421BG.
LPA Danielle Anderson informed licensee Myraiam Eugene that this report dated 8/8/2025 documents two Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.
Also, LPA Danielle Anderson informed the licensee Myriam Eugene to provide a copy of this licensing report dated 8/8/25 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to parents/guardians of any newly enrolled child for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A copy of this report and a Notice of Site Visit (LIC 9213) was given to Licensee Myriam Eugene and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
