On 12/20/24 at 10:10AM, Licensing Program Analyst (LPA) Luigi Gargaro, conducted an announced prelicensing inspection for a relocation with the applicant to ensure compliance with standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. Analyst met with applicant Rose Marie Tineus and spouse, Wilson Verne, during visit. Ms. Tineus and Mr. Verne speak very limited English, however, analyst was able to communicate with the couple with the use of Focus International Translation telephone service that he had available for today's visit.

The one story detached apartment home was toured and inspected to ensure an environment safe for the care and supervision of children. The fire extinguisher and smoke and carbon monoxide detectors meet requirements and are operational. All hazardous items were latched/locked and secured out of reach of children. The applicant was asked whether she had any bodies of water or weapons in the home and she replied no and analyst saw no bodies of water on the premises. CPR and First Aid expire in August of 2026. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. Applicant rents the home and provided proof of control of property in the form of a lease agreement that was submitted with her original application.

Applicant will be using the following rooms for childcare: the living/day care room, the second home bedroom and the home bathroom. Off limits are the kitchen and the first home bedroom. The kitchen is made off limits with a secured child safety gate that is installed in the entrance way between the living room and the kitchen and the first bedroom is made off limits with a locking entrance door handle. The home has a wall heating unit that applicant attests is not operational but she has encased it in a wooden box to prevent children from accessing its metal parts. Applicant understands that if the heater is ever made operational, she will be required to install a safety gate or other device that will allow the heater to operate safely but make still make it inaccessible to children. The applicant has sufficient toys and equipment available.

The home has a backyard area that will be permanently off limits to the day care as due to the terrain and other hazards it is not suitable for use by children. The yard is made off limits with with a locking kitchen exit door that is found in the off limits kitchen. The home also has a gated front yard that will also temporarily be made off limits to children as the right side alley way leading toward the off limits back yard does not have secured gating to prevent children from accessing the backyard and the yard also has uneven loose bricks beneath the imitation turf installed in the yard.

Applicant states the yard will remain off limits until a new, secured gate is installed at the entrance of the side alleyway and the flooring in the front yard is leveled so that there are no tripping hazards. Applicant understands that once the yard renovations have been completed, she will not be able to start using it until the area is inspected and approved by Licensing during a future visit. Applicant states in the meantime she will take children to a local park for outdoor activities whenever needed.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA and applicant discussed California Megan's Law and he provided applicant with the website address: www.meganslaw.ca.gov for her to review information regarding her facility on a regular basis. Applicant was reminded of requirements for children’s records, child abuse and unusual incident reporting, immunizations, adults living or working in the home and associated civil penalties, shaken baby syndrome, and SIDS. Applicant was reminded that corporal punishment, smoking, walkers, exersaucers, bouncy seats and jumpers are not allowed in day care.

A license for 8 will be issued after the following correction: applicant's address was mistakenly entered as 3320 Highland Avenue, Unit H based on what was indicated on a page of the lease. The physical address of the home is 3220 Highland Avenue which is also shown as an address on the lease. Analyst to contact leasing management company to resolve the conflicting address information and once receives a correct copy of the home lease will issue a license for 8 for the home.
