32 | child in an aggressive manner. The licensee denied the allegation. They stated that when child (C6) was running inside the house, facility assistant (S2) reached out to stop C6 and held the child's arm to prevent C6 from being injured. S2 confirmed the action was protective, not aggressive. Physical inspection revealed no marks or injuries on C6's arm. Both the licensee and S2 denied ever using physical discipline. Children and parents interviewed reported no observations or experiences of inappropriate behavior, hitting, or grabbing by the staff.
It was alleged that licensee does not treat daycare children with dignity and respect and that children are treated differently. It was alleged that licensee does not allow child (C5) to play with other children. Licensee and assistant both denied the allegation and stated the only limitation is a safety policy separating children by age. Five (5) children interviewed did not express being treated differently and expressed positive comments for both licensee and assistant.
It was also alleged that the licensee screamed at child (C5) when asking a question. The licensee and S2 both denied the allegation, stating they do not scream or yell at the children. Licensee admitted to having a naturally strong, loud voice and acknowledged that outsiders might occasionally misperceive this firm tone as yelling.
Four (4) children denied that the licensee yells. One (1) child noted the licensee has a loud voice but clarified it is not yelling, adding that the tone is neither threatening nor frightening.
Interviews with parents revealed a high level of satisfaction regarding the care their children receive at the facility. None of the parents expressed any concerns.
Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
Exit interview was conducted and the report was reviewed with Licensee, Hilda Barrios.
A Notice of Site Visit was given and must remain posted for 30 days. |
