32 | The Director speculated that the current and similar previous allegations are being made by a disgruntled employee as a form of harassment/retaliation. The Director explained that facility staff have reached out to the parents during meetings and conferences, and none had expressed any concerns about staff or children behavior. The facility staff stated that they do have children with challenging behaviors, but they have been trained on how to handle each individual situation. Staff denied yelling at children and stated that children are under constant supervision to prevent any inappropriate behaviors.
Children interviewed disclosed that teachers are nice and denied that staff yell. LPA observed children to be smiling and laughing in their classrooms and on the playground during facility tours. Parents interviewed did not disclose any concerns or issues with the facility, children, or staff.
Based on conflicting information obtained and no other witnesses to corroborate the above allegations, LPA was unable to confirm, whether or not, staff yell at or are not adequately supervising children in care. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.
Exit interview was conducted and report was reviewed with director, Mariela Arce-Hurtado. A copy of this report, along with Appeal Rights (LIC9058 03/22), was provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
