On July 16, 2024, at 2:00 PM, Licensing Program Analyst (LPA), Diana Sanchez made an unannounced complaint inspection to deliver the complaint investigation findings for the above allegation. LPA met with director Mariela Arce and explained the purpose of today’s inspection. Current census is 15.

This agency has investigated the above listed allegation. During the investigation, LPA conducted facility inspections, interviews with facility staff, daycare children and daycare parents.

It was alleged that staff are not preventing daycare child #1 (C1) from engaging in physical altercations with other children. The facility director acknowledged that there are several children enrolled in their program that exhibit challenging behaviors, as the facility is a Therapeutic Preschool, designed especially for children affected by domestic violence and/or abuse; however, the director stated measures are taken to ensure appropriate supervision. Facility director acknowledged that C1 has exhibited severe challenging behaviors but explained facility staff have made coordinated efforts to integrate C1, while protecting other daycare children in care.

According to facility staff, a Safety Plan was implemented in December 2023 and in February 2024 a behavioral therapist was assigned to work with C1 on a one-on-one basis, which had help him with interaction with other children. Children interviewed have observed C1 engaging in physical altercations with children and staff.

There is insufficient evidence to corroborate the above allegation. LPA was unable to determine whether or not C1’s behavior rises to the level of a personal rights violation and/or whether facility staff have implemented sufficient strategies to prevent such violations. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.

Exit interview was conducted and report was reviewed with director Mariela Arce. A copy of this report, along with Appeal Rights (LIC9058), was provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
