On 9/10/24 at 9:00AM, LPA Patrick Ma made an unannounced complaint visit for the complaint received on 7/29/24 for the purpose of continuing investigation and delivering findings on the above reference allegations. LPA met with Director, Vanessa Milroy. LPA conducted staff interviews, made a confidential names list, reviewed staff files, and other relevant documents.

Based on investigative interviews and documentation reviewed it is determined, staff S1 has spoken inappropriately to day care children by yelling at them and using an unnecessary forceful tone when providing redirection. On at least 3 separate occasions, S1 violated children’s personal rights by grabbing their arms swinging them in another direction, yanking them, and exhibiting other rough behaviors toward children as a means of discipline and/or redirection. S1 is no longer working at the facility. Investigation interviews also determined children in the 2’s classroom have been left unproperly supervised when there is only one staff in the classroom when changing diapers.

Due to the position of the diaper changing table, a single staff in the classroom cannot supervise children behind them if they are using the changing table. Also, teachers changing children’s diapers struggle to supervise and assist potty training children use the bathroom properly, which leads to accidents. Documentation review determined in March 2024 C1 was found leaving an unsupervised classroom and assisted by a discovering staff to rejoin their classroom.

The allegations are valid because the preponderance of the evidence has been met, therefore, the above allegations are found to be SUBSTANTIATED. The deficiencies are being cited on the attached LIC 9099D.
LPA informed facility representative Brandi Christman that this report dated 11/8/24 documents 1 Type A citation which shall be posted for 30 consecutive days as there was an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA informed the facility representative to provide a copy of this licensing report dated 09/10/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the Director Vanessa Milroy. A notice of site visit was given and must remain posted for 30 days.

Director states that on 8/28/24 she conducted a staff meeting on children's personal rights and Forbidden Acts. LPA's obtained a copy staff training agenda and reviewed signed staff behavioral guidance sheet confirming they participated in training. Deficiency cleared at visit.

Based on investigation interviews and documentation children in the 2’s classroom have been left unsupervised in situations when a single staff is using the diaper changing table and unproperly supervised using the bathroom while they are potty training. Also, documentation determined child C1 was left unsupervised in a classroom and discovered by a staff which posed a potential health, safety or personal rights risk to children in care.

Director will provide the department with sign-in sheet of all the staff that have reviewed the training and proof of repositioned table by 10/10/24.
Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.
