On July 23, 2025, at 9:30 AM, Licensing Program Analyst (LPA), Gloria Gonzalez conducted a complaint inspection to deliver findings and met with Interim Director, Thanh Warrens regarding the above allegation. LPA advised Warrens of the purpose of the inspection and conducted a tour of the facility. There were 46 daycare children and 8 staff members present during the inspection.

On 5/7/25, Community Care Licensing (CCL) received a complaint alleging Staff did not notify authorized representative of injury to child in care. During the course of this investigation, interviews were conducted with the Director, Assistant Director, Staff Members, Daycare Children, and Daycare Parents. Records and video footage was reviewed.

It was determined that on 04/24/2025, Child #1 (C1) sustained a serious injury on the playground at 4:16 p.m. Staff confirmed that C1 could not extend his arm to the max because it was painful. Staff stated they took C1 to the front desk and notified the Director of the injury.

C1 was assessed and then brought back to the playground to sit on a bench for observation by staff. The facility did not immediately notify the child's authorized representative of the injury until the child was picked up at approximately 4:34 p.m. C1 sought medical treatment and was diagnosed with a fractured elbow. Based on interviews which were conducted and records review, the preponderance of evidence standard has been met, therefore the allegation of staff did not notify the authorized representative of an injury while in care is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 9099D. See 9099-C for continuation.

A Type B Deficiency is being cited. See LIC9099D.

LPA reviewed Title 22 regulation regarding reporting requirements, with Interim Director, Thanh Warrens. A Notice of Site Visit (LIC 9213) was given to Assistant Director, Thanh Warrens and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

An exit interview was conducted and the report was reviewed with Interim Director, Thanh Warrens.

Warrens stated that she will submit an updated protocol step by step on notifying authorized representative of injuries that are more serious than minor cuts or bruises. Warrens stated she will watch the CCL video on reporting and submit a written summary on what was learned. Warrens stated on 8/5/25-8/8/25

Based on interviews and records reviewed, the Licensee did not comply in immediately notifying the child's authorized representative when the child sustained a serious injury on 4/24/25 at 4:16 pm and notified at pick up time at 4:34 pm, which poses a potential Health and Safety risk to persons in care.

there will be staff trainings and will include training on reporting to the department and authorized representative. Warrens stated that she will submit a list of training topics and staff sign in sheets to the Department. Warrens stated she would like to set up a visit with Technical Support Program to help support and educate staff on CCLD regulations.
