32 | C1 was assessed and then brought back to the playground to sit on a bench for observation by staff. The facility did not immediately notify the child's authorized representative of the injury until the child was picked up at approximately 4:34 p.m. C1 sought medical treatment and was diagnosed with a fractured elbow. Based on interviews which were conducted and records review, the preponderance of evidence standard has been met, therefore the allegation of staff did not notify the authorized representative of an injury while in care is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 9099D. See 9099-C for continuation.

LPA reviewed Title 22 regulation regarding reporting requirements, with Interim Director, Thanh Warrens. A Notice of Site Visit (LIC 9213) was given to Assistant Director, Thanh Warrens and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
