32 | Regarding the allegation Staff handled infant in care in a rough manner.
During the investigation, interviews with staff on 03/23/26 revealed that a previous parent concern brought to the Directors attention in Fall 2025. The Director addressed the concern promptly and spoke to staff and conducted observations in the infant classroom. The Director determined no inappropriate handling had occurred and followed up with the parent to inform them of their findings.
On 03/23/26, interviews conducted by LPA Gerth with S1-S5, corroborated that there have been no disciplinary measures taken with any staff for rough handling of infants in care, no additional parent concerns brought to their attention, nor have any staff observed rough handling to occur. Staff interviews also disclosed that the staff member specifically named in the allegation has not been observed to handle infants in a rough manner at any time nor do any fellow staff members have concern of this. Additionally, during the investigation, LPA Gerth conducted observations in the infant room and observed that the handling of infants in care to be appropriate. Therefore, based on observations made, interviews conducted and evidence gathered, there is not a preponderance of evidence to prove the alleged violation occurred, therefore the allegation is UNSUBSTANTIATED.
Regarding the allegation Staff yelled at infants in care. During the complaint investigation, LPA Gerth made attempts to interview and/or conducted interviews on 03/23/26, 03/25/26, 03/26/26 and 04/01/26. Interviews conducted revealed that there have not been specific parent concerns of staff yelling at infants, brought to the attention of the CCC. Although a parent has reported information to the director about the volume of a staff member, no concerns have been brought to the Directors attention about staff yelling at infants in care. During the investigation, LPA Gerth conducted file reviews as well as interviews with S1-S5 and did not find evidence of any staff having been found to yell at infants and staff deny witnessing any coworkers yelling at infants in care.
On 03/26/26, LPA Gerth also conducted observations of both the indoor and outdoor infant activity spaces and found that due to the layout of the CCC, some voices do carry and different areas of the CCC may seem louder at times. LPA observed staff to use appropriate tone and volume when communicating with infants. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED.
A copy of this report, appeal rights and Notice of Site Visit were provided to Director Evelyn Avila and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. |
