On 8/8/25 at 8:37 a.m., LPA Renita Rodriguez made an unannounced visit to deliver findings, for the complaint received on 6/9/25, regarding the above allegation. LPA met with Assistant Director Kasey Deamude. LPA observed ratios and there was a total of 30 children with 5 staff.

It was alleged "Staff forced daycare children to stay on their bed", per interviews an incident took place during nap time on 5/28/25. The information was reported by Staff S1 to Director and Assistant Director on 5/29/25. S1 stated Child C1 was not laying still on their mat. S1 sat down on the floor next to C1. S1 then placed a bent leg over the child's legs to keep them still. The ability for the child to move was attempting to be restricted.

Training regarding personal rights is provided as teacher training once a staff member has been hired. Personal rights is completed during August of every school year.

Based on the information obtained during interviews, observations, and documentation reviewed it is determined that S1 placed leg over C1 in an attempt to limit and or restrict child's movement. The allegation is valid because the preponderance of the evidence has been met, therefore, the above allegation is found to be Substantiated. California Code of Regulations, (Title 22, Division 12, Chapter number 1) the deficiency is being cited on the attached LIC 9099D. The Notice of Site Visit was provided, and LPA observed posting. Exit interview conducted and report was reviewed with the Assistant Kasey Deamude.

Based on interviews staff S1's placement of leg over child during nap time when child would not stay still posed a potential Health, Safety or Personal Rights risks to persons in care.
