On 1/4/2023 at 11:32AM, Licensing Program Analyst (LPA), Nancy Diaz conducted an unannounced case management inspection for the Action Level Exceedance (ALE) of lead detected in facility water fixture. LPA met with Holly Weber, Director. The purpose of the inspection was explained and facility was toured. Present in facility were 39 children and 4 staff members (Atyah Kushkaki, Holly Bolt, Asia Garcia and Sumana Ray).

LPA discussed the new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.

LPA obtained copies of the External Water Sampler Self-Certification Form (LIC9275), Child Care Center Sampling Checklist (LIC9276) Facility Sketch (LIC999) on 12/30/2022.

On 12/15/2022 the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 11/26/2022. The outlets/fixtures reported with 5.5 ppb or greater lead exceedance levels were as follows:

Sink B (Room #1) - 200 ppb
Sink C (Room #2) - 5.6 ppb

Mrs. Weber stated that the facility always provided water from the kitchen via Brita water pitchers that filters out chemicals. LPA observed Brita pitchers (and drinking cups) easily accessible to children. Mrs. Weber stated that she will turn off the drinking water permanently (Sinks B & C) and ensures that Brita pitchers be available to children at all times.

Based on water testing results and interviews, facility tested over the Action Level Exceedance level for B (Room 1) & C (Room 2) sinks. Mrs. Weber stated that these sinks were never used for drinking and are mainly used for handwashing only. This posed a potential health, safety or personal rights risk to children in care.

Mrs. Weber shall submit a written statement no later than 1/11/2023 indicating that both water resources (Sink B & C) were turned off permanently.

Mrs. Weber stated that the children never used the drinking fountain as the facility always provided Brita water pitcher next to the sink with water cups easily accessible to children. LPA observed Brita pitchers in all the classrooms today.

Director will post the lead water testing report for parents to review during today's inspection.

Exit interview conducted and report was reviewed with Holly Weber, Director. A copy of this report, along with Appeal Rights (LIC9058), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
