25 | On 12/14/22 at 3:21pm Licensing Program Analyst (LPA), Martha Malane conducted an unannounced case management inspection for the purpose of following up on a self-reported incident dated 12/7/22. Upon arrival, LPA met with Director, Marina West. LPA disclosed the purpose of the inspection and was led on a tour of the facility. There were 23 children and two (2) staff members present. Hours of operation are Monday – Friday 8:00am – 5:00pm.
Director stated that on 12/7/22 at 10:30am there were five (5) staff and 23 children in the preschool yard. The preschool yard is located directly outside the classroom doors. At 10:15am Child 1 (C1) left the boundaries of the preschool play yard and entered the Grasshoppers Classroom without supervision. C1 then walked through the classroom to the outside courtyard without supervision where a construction worker noticed the child. At that time, staff member Gabby Farr walked to the courtyard and provided supervision to C1.
The director stated there are cameras in the preschool classrooms, however during the installation construction of new windows, cameras were not in operation.
Based on the obtained information, a Type A violation of California Code of Regulations, (Title 22, Division 12), is being cited on the attached LIC 809D.
LPA informed Director, Marina West that this report dated 12/14/22 documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Director, Marina West to provide a copy of this licensing report dated 12/14/22 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Director, Marina West with a blank LIC 9224 form.
LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
