25 | On April 17, 2023 at 8:40 a.m. Licensing Program Analyst, Leilani Curtis, conducted an unannounced inspection to follow up on a self-reported incident that occurred on 03/23/2023, wherein a staff member (S1) pulled a child (C1) by the hand. Upon arrival LPA met with Lead Teacher Diana Padilla, advised her of the purpose of the visit, and proceeded to tour the facility. There were 26 children with 6 staff members present. Appropriate ratio/capacity was observed. Staff members have the required background clearances and are associated to the facility.
LPA interviewed the director (via telephone from the facility), staff #2 (S2), staff #3 (S3) and child #1 (C1). On 03/23/23 at approximately 2:50 p.m., S1 removed C1 from a chair at the classroom table. S1 took C1 by the hand and lead her to a couch in the quiet area of the classroom away from the other children. Based on video footage reviewed by LPA, S1 appeared to slightly pull C1. The staff member walked with C1 at a pace the child had difficulty keeping up with. C1 states that she “tried to stop but the teacher was too strong”. The video footage supports the events of the incident as described through staff interviews. The child was not injured. At the time of the incident there were three staff members supervising 14 children in the classroom. Appropriate capacity and ratio were in place. The parent/guardian of C1 notified the director of the incident on 3/24/23 and Community Care Licensing was notified timely. The director states that while the incident was investigated S1 was placed on administrative leave. Now that the investigation has been completed S1 has been suspended for five days with no pay and has been placed on a performance plan.

An exit interview was conducted, and this report was reviewed with Diana Padilla. Appeal Rights (LIC 9058) were provided. Ms. Padilla’s signature on this form acknowledges receipt of these rights. LIC 9213 NOTICE OF SITE VISIT FORM IS REQUIRED TO BE POSTED FOR 30 DAYS. LPA observed Ms. Padilla post notice of site visit.
