On 12/27/24 at 8:15 AM , Licensing Program Analyst (LPA) Annette Sutherland conducted an unannounced complaint inspection. The purpose of this inspection is to investigate a complaint received regarding the above allegation. The initial complaint was received on 12/18/24. Upon arrival LPA met numerous staff members and facility Director arrived shortly . LPA toured outdoor play area with Ms. Miriam Habib and later with Ms. Amanda Lundy. Observed present were 19 children and 3 staff member in 2 classrooms. Interviews were conducted with staff members that supervise the outdoor 3-4 year old play area. S1 reported the fence plank top portion unattached to Assistant Director on 12/18/24. LPA arrived today and plank when pressed becomes unattached. Facility handy man present was able to fix the plank and reattach it today during visit. According to staff who were supervising on 12/18/24, the plank detached when a child hit it with their tricycle. LPA was able to push the plank creating a 6 inch gap.
Children are able to kick the plank open. Gap between planks is not wide enough for child to get out. Gap creates unsafe area for children.

On 12/27/24 at 10:30 AM, Licensing Program Analyst (LPA) Annette Sutherland conducted an unannounced complaint inspection regarding the above allegation. LPA Sutherland met with Director Amanda Lundy. Census was 19 children and 3 staff members in 2 rooms.
The Department investigated the above allegation and obtained information from interviews with multiple staff members. Staff #1 supervised children playing outside on 12/18/24 and reported child hitting fence with tricycle resulting in fence plank detaching. Child was not hurt during incident.
Based upon this information, although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred at this facility and is therefore UNSUBSTANTIATED.
An exit interview was conducted with the Director . A Notice of Site Visit (LIC9213) and Appeal Rights (LIC9058) were provided along with the report (LIC9099) to the Director. Notice of Site Visit must be posted for 30 days.

Based on the information obtained during interviews with staff and LPA's observation, the preponderance of evidence standard has been met, therefore, the allegation are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 1) deficiencies are being cited on the attached LIC 9099D. The Notice of Site Visit was provided, and LPA observed posting. Director was advised that it must remain posted for 30 days. An exit interview was conducted, A copy of this report and Appeal Rights were discussed and provided.

Fence was fixed today while LPA was present. Director understands that she must check on fence periodcally to make sure planks are attached and fence is in safe condition.

Based upon facility interviews with multiple parties, the facility did not fix the broken fence upon notification which poses a potential health, safety and personal rights risk to children in care.
