On 5/5/26 at 9:50am, Licensing Program Analyst (LPA) Keely Messerschmidt arrived at the facility for the purpose of continuing investigation and delivering the complaint findings on the above-referenced allegations. LPA met with Director Wendy Hernandez, informing her of the purpose for the visit. LPA toured the facility, conducted census, and verified facility staff and children enrollment.

On April 7th, 2026, Community Care Licensing (CCL) received a complaint alleging that staff are not preventing day care child from harming other day care children and that facility is operating out of ratio.

Pertaining to allegation that staff are not preventing day care child from harming other day care children, based on interviews conducted staff stated there have been children in the 2 year old classroom with behavioral challenges but the teachers do their best to redirect the children, split into groups and keep extra staff in the room for additional support. It was disclosed that splitting the classroom up assisted with the behaviors and the director would step in to support as needed.

Regarding allegation that facility is operating out of ratio, based on interviews conducted staff members stated they are never out of ratio. It was disclosed that in the 2 year old classroom they were once doing Title 5 ratio but due to the classroom having less than 50% Title 5 enrollment they are able to be under Title 22 ratio. It was also stated that they try to keep at least 3 to 4 staff members in the 2 year old classroom at a time for support. Based on record review, LPA observed Child Supervision Records (CSR) for the 2 year old classroom and each day classroom was within the appropriate teacher to child ratio.

Based on the information obtained during this investigation, it has been determined that although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violations did or did not occur. Therefore, the allegations are UNSUBSTANTIATED.

An exit interview was conducted, and this report was reviewed with the Director, Wendy Hernandez, and a copy was provided. Appeal rights were discussed and provided during the exit interview. A Notice of Site visit was given, and Dircetorunderstands that it must remain posted for 30 days.
