13 | On 6/1/26 at 10:45 am, Licensing Program Analyst (LPA) Gerald Poindexter conducted an unannounced visit for a complaint received on 3/18/26. The LPA met with Samantha Aguirre, center director. There were 47 children present in 4 classrooms -- Infants 1 & 2 and Toddler 1 & 2 -- with 13 staff. Facility is within ratio and capacity.
During the investigation, LPA Poindexter observed classrooms, toured the facility, reviewed facility documents, and interviewed relevant parties, including parents of children in care.
The Reporting Party (RP) alleged that “staff are not ensuring facility operates in ratio,” as observed in Toddler Room 1. LPA conducted interviews that validated the allegation. LPA also reviewed staff sign-in/sign-out sheets and children’s attendance, which indicate that the classroom exceeded the required teacher-child ratio in at least one verifiable instance. 32 | that one qualified staff member was left alone for nearly 30 minutes with 19, active, non-napping children, and without support from another teacher or aide.
The RP alleged that “staff are not ensuring a safe and comfortable environment for day care children in care” as it related to comfortable temperatures in the infant classrooms. It was also alleged that construction at the facility presented potential hazards. LPA Poindexter observed construction scaffolding at the entrance to the facility, as well the presence of nails and electrical cords on the ground immediately outside the facility’s Toddler 2 classroom. The director stated that the construction had been underway for several days. During the visit, the director had nails removed and electric cords covered to prevent tripping. LPA observed that temperatures at the facility were comfortable, and that cooling equipment was functioning. Feedback from staff interviews, indicate that with hotter weather, classrooms sometimes got warmer – most notably, when windows and doors were open – but that generally, temperatures were comfortable. Parents interviewed did not have feedback that aligned with the allegation.
Based on information obtained from observation, interviews with relevant parties, and provided documentation, the above allegations are found to be SUBSTANTIATED. The allegations are valid because the preponderance of evidence has been met.

Exit interview conducted and report was reviewed with Samantha Aguirre, center director. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were provided. |
