On 09/12/2024, Licensing Program Analysts (LPAs) Michelle Hood and Julieta Abrego conducted an unannounced initial 10-day complaint inspection regarding the above allegations. The LPAs met with the director Emma Sewell. The director led LPAs on a tour of the facility. LPA Abrego observed 13 children with two staff in Classrrom #1, 16 children with three staff in Classroom #2, three children with two staff in Classroom #3, five children with two staff in Classroom #4, six children with two staff in Classroom #5, and four children with one staff in Classroom #6.

LPAs interviewed the director, assistant site supervisor, and six staff. LPAs obtained a copy of the children's roster and sign-in sheets. Based on interviews, it was determined a three year old was found unsupervsied in the Early Headstart playground. The director and assistant site supervisor admitted they did not report the incident to the Licensing Dept. within 24 hours, and did not submit an Unusual Incident Report (UIR) within seven business days.

The preponderance of evidence standard has been met; therefore, the allegations were found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, are being cited.

LPA Hood informed the director Emma Sewell that this report dated 09/12/2024 document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Hood informed the director Emma Sewell to provide a copy of this licensing report dated 09/12/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview was conducted and the report was reviewed with the director Emma Sewell. The director was provided with a copy of their appeal rights (LIC 9058 3/22) and their signature on this form acknowledges receipt of these rights. Notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. See LIC 9099D for deficiencies.
