On February 15th, 2024, at 8:35 AM, Licensing Program Analyst (LPA) Jo Ann Legaspi conducted a case management inspection to follow-up on a self-reported incident that occurred on 02/02/2024. LPA advised Assistant Director Anay Weiser-Barajas of the meeting’s purpose and was granted facility entry.

The facility serves children ages 2 – 5 years. The following ratios were observed in 4 classrooms: Room 1 had eleven (11) children (aged 18 months to 3 years) supervised by two (2) staff. Room 2 had thirteen (13) children (aged 2 - 3 years) supervised by two (2) staff. Room 3 had fourteen (14) children (aged 3 - 4 years) supervised by two (2) staff. Room 4 had eight (8) children (aged 4 years) supervised by one (1) staff.

On 02/02/2024, Child 1 (C1) was left alone in their classroom for about 5 – 10 minutes while their room transitioned to the playground. (See LIC 811 Confidential Names). S1 entered the room and found C1 alone standing next to the room’s cubby shelves. S1 brought the child to their class already outside. Based on staff interviews and record reviews, a Type A violation of California Code of Regulations, (Title 22, Division 12. Chapter 1), is being cited on the attached LIC 809D. LPA provided Staff Weiser-Barajas with a copy of Health & Safety Code Section 1597.58 – Civil Penalties; Regulations Setting Forth Appeal Procedures for Deficiencies. A civil penalty of $500 has been assessed. See Civil Penalty Assessment (LIC 421IM) for detailing information.



LPA Jo Ann Legaspi informed Staff Weiser-Barajas that this report dated (02/15/2024) documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Legaspi informed Staff Weiser-Barajas to provide a copy of this licensing report dated (02/15/2024) that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly

enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Staff Weiser-Barajas with one (1) blank LIC 9224 form.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Assistant Director Weiser-Barajas.

The room’s cubby shelves were removed for greater room visibility. Staff said teachers will be retrained on face to head counts on 02/16/2024. Staff said they will provide LPA with a copy of the staff training agenda and staff training sign in sheet no later than 02/23/2024.

Based on observations and interviews, the Licensee did not comply with the section cited above in that a child was left without the visual supervision of a teacher, which poses as an immediate health, safety or personal rights risk to persons in care.
