On July 16, 2024, at 10:15 a.m., Licensing Program Analyst (LPA) Cindy Meier conducted an unannounced complaint inspection to deliver the findings of the above allegation. LPA met with Director, Geovani Hernandez and advised the director of the purpose of the inspection and was led on a tour of the facility. There were forty-eight (48) children present with seven (7) staff members at the time of the inspection.

During the course of the investigation, LPA conducted interviews with facility staff, day-care children, and day-care parents. The staff roster, classroom rosters, facility roster and photographs were obtained and reviewed by LPA.

Three (3) areas of supervision were reviewed which included supervision at nap time, playground supervision and staff exiting the classroom, leaving children unsupervised. It was alleged that Teacher #1 (S1) sleeps while children nap, although there was

insufficient evidence to support the allegation, the facility has implemented new supervision practices that better align with Title 22 regulations. It was also alleged that staff use their cellphones for personal reasons while supervising children on the playground; there was no evidence obtained to support the allegation and a record review suggests that teacher-child ratios are maintained during playground activities.

Based on witness interviews and staff admissions, it was determined, that on numerous, unidentified dates throughout the year, staff have either participated or observed staff exit classrooms to gather items or use the restroom, leaving children unsupervised for approximately 2-5 minutes per exit. Testimony from eight (8) staff and two (2) children confirmed this practice.

Based on LPAs interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D. An Immediate Civil Penalty in the amount of $500.00 is assessed for the Absence of Supervision. See LIC421IM.

LPA Cindy Meier informed Director, Geovani Hernandez, that this report dated 7/16/24 document(s) (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.

LPA Cindy Meier informed the Director, Geovani Hernandez to provide a copy of this licensing report dated 7/16/24 that documents Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with Director, Geovani Hernandez. A copy of this report, along with Appeal Rights (LIC9058 03/22), were provided. A Notice of Site Visit was given and must remain posted for 30 days.

This is an amended version of the original report created on 07/16/24.
Based on interviews and staff admissions, the licensee did not comply with the section cited above in that it was determined that on numerous unidentified dates staff left children unsupervised in the classroom, which poses an immediate health and safety risk to children in care.

past each other during transitions, but interaction is minimal, if at all. According to staff, during occasional all school assemblies or events, the groups are present in the same location, but are in designated areas with staff supervision. Children interviewed denied the allegation.

Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incident, LPA was unable to determine whether or not the allegation occurred. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the above allegation is UNSUBSTANTIATED.
