On 05/21/26 at TIME, Licensing Program Analyst (LPA) J.C. Valdez conducted an unannounced complaint visit to deliver findings for the complaint received 03/24/26 for the above referenced allegations. LPA met the Director, Emalina Ledbetter. There were 10 kids and 2 staff in 1 classroom.

It was alleged that staff handled day care children in a rough manner, staff did not prevent day care child from hitting another child resulting in injury and staff left day care children unattended. Based on staff interviews, it was determined that on 04/30/26 at approximately 1:00 PM, teacher (S8) physically restrained child (C1) by holding the child down on their cot during nap time, constituting a violation of the child’s personal rights. During the investigation, LPA also discovered that there were two supervision lapses on 04/30/26: at about 9:30 AM, child (C2) was observed outside the classroom unsupervised for about two minutes and at about 4:30 PM, child (C3) was also left unattended for approximately two minutes while (S8) assisted other children in the bathroom.

On 05/22/26 LPA J.C. Valdez made an unannounced visit to continue the investigation, for the complaint received on 3/24/26, regarding the above allegation(s). LPA met with Director, Emalina Ledbetter. There were were 10 kids and 2 staff in 1 classroom.

It was alleged that facility staff yelled at children and improperly disposed of a child’s food. LPA conducted interviews with staff and reviewed observations from inspections on 04/01/26 and 04/15/26. Interview statements were inconsistent, and no observations were made of staff yelling at children or disposing of food inappropriately. Based on the information obtained, it could not be determined that staff yelled at children or discarded children’s food before they finished eating or before meals were offered multiple times. Although the allegation may have occurred, there is not a preponderance of evidence to support the claim. Therefore, the allegation is UNSUBSTANTIATED.

In addition, At approximately 4:15 PM on 5/1/26, C1 attempted to report an injury caused by another child. S8 was observed disregarding the child’s concerns, failing to provide medical attention, and expressing reluctance to complete the required injury report, stating C1 had “been bad all day.” Based on the evidence, the Licensing Program Analyst (LPA) determined that the (S8’s) lack of supervision, handling C1 in a rough manner and failure to respond to a child injury poses a potential health, safety, and personal rights risk to children in care. The allegations are valid because the preponderance of the evidence has been met, therefore, the above allegations are found to be SUBSTANTIATED.
