On June 7, 2023 at 1:15 p.m. Licensing Program Analyst (LPA) Leilani Curtis conducted an unannounced inspection to deliver the findings on the complaint allegations referenced above. Upon arrival LPA met with Director Emalina Ledbetter and proceeded to tour the facility. There were 18 napping children present with 3 staff members. Appropriate ratios were observed. Staff members have the required background clearances and are associated to the facility.

The initial complaint investigation was conducted by LPA Curtis on 4/20/23. Throughout the course of investigation, interviews were conducted with the complainant, several staff, and several parents. Facility records were obtained and reviewed. The information obtained from interviews and facility records were contradictory to the allegations. Based on this information, the allegations are determined to be unsubstantiated which means although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the alleged incidents or violations occurred at the facility.

An exit interview was conducted with Director Ledbetter and Appeal Rights (LIC 9058) were discussed. A copy of this report as well as a copy of the appeal rights were given to Director Ledbetter. LIC 9213 NOTICE OF SITE VISIT FORM IS REQUIRED TO BE POSTED FOR 30 DAYS. LPA observed the director post Notice of Site Visit.

The initial complaint investigation was conducted by LPA Curtis on 4/20/23. Throughout the course of investigation, interviews were conducted with the complainant, several staff, and several parents. According to interviews the classrooms and carpets/rugs within the facility smell on occasion, and some of the panels on the roof of the outdoor walkway between the classrooms are missing. LPA Curtis observed the missing roof panels during the 4/20/23 inspection.

Based on interviews conducted by LPA and observation the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED, California Code of Regulations, Title 22, 101238(a) is being cited on the attached LIC 9099D.

The director states that she will have the carpets/rugs in the facility cleaned every three months and she will submit a written schedule for the carpet/rug and classroom cleanings.

Based on observation and interviews conducted by LPA several classrooms and carpets/rugs within the facility smell on occasion, and some of the panels on the roof of the outdoor walkway between the classrooms are missing. This poses a potential, health, safety or personal rights risk to the children in care.

The director also states that she will create a written schedule/plan for repairs to the outdoor covered walkway. The director will submit the documents to LPA via email by 6/21/23.
