32 | It was alleged that on multiple occasions staff were excluding daycare child (C1) during activities with other children in care and that staff handled C1 in a rough manner. All eight (8) staff interviewed, denied the above allegations, stating they were not aware or have witnessed any staff intentionally excluding C1 during activities with other children in care. Site Supervisor explained the facility does utilize a calming room when staff feel children need to be removed from a situation as a method of redirection or to avoid overstimulation. Staff stated that children have the option of participating in planned activity or choosing a different activity.
Staff denied handling C1 or any daycare children in a rough manner. The outside agency representative denied observing facility staff rough handling C1 or any daycare children; however, they recommended staff implement alternative methods of guidance for children exhibiting challenging behaviors. Parents interviewed, stated they have not observed any staff handling children in a rough manner or intentionally excluding children from activities. Parents interviewed were satisfied with the care their children receive and were complimentary of the outside services provided by the facility.
Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are unsubstantiated.
Exit interview conducted and report was reviewed with Site Supervisor, Patty Salazar. A copy of this report, along with Appeal Rights (LIC9058 03/22), were provided. A Notice of Site Visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
