On this date and time, Licensing Program Analysts (LPAs) Nasha King and Cindy Hamilton arrived at the facility for the purpose of concluding an investigation into the above-referenced allegations. An initial visit was conducted on 11/12/2021, and the investigation was extended. LPAs conducted COVID-19 screening questions prior to entering the facility with Lead Teacher, Diana Martinez, and informed Ms. Martinez of the purpose of the visit. During this visit, LPAs toured the facility, conducted census, and observed that the facility was operating within ratio.

It was alleged that:
• Staff did not provide adequate service to child in care.
• Child was hit by another child in care.
• Facility operating out of ratio.

In regards to the allegation staff did not provide adequate service to child in care, interviews revealed that staff members could not recall an incident when S2 denied C1 access to their water bottle, and therefore, denied that the alleged incident occurred. LPA King was not able to obtain additional information from the Reporting Party specific to the complaint allegations and could not corroborate the allegation, as the Reporting Party did not return any of LPA King’s telephone calls.

In regards to the allegation child was hit by another child in care, interviews revealed that staff are aware that children sometimes hit or push each other. Additionally, if the hit or push does not cause hurt to the child, an Ouch Report is not generated, and the teacher will always redirect the children and talk to them about being nice to their friends. LPA King was not able to obtain additional information from the Reporting Party specific to the complaint allegations and could not corroborate this allegation, as the Reporting Party did not return any of LPA King’s telephone calls.

In regards to the allegation facility operating out of ratio, records review and interviews revealed that the facility has been operating within ratio in that there are always two (2) teachers in the classrooms and sometimes three (3) teachers when there are more than twenty (20) children in the classrooms. Additionally, during today’s visit, LPAs observed two (2) teachers supervising (10) children in the Ladybugs Classroom (3.5 - 5 yrs) and one (1) teacher supervising six (6) children in the Grasshoppers Classroom (young 2 - 3 yrs). Visual observations conducted during LPA’s visits on 11/12/2021 and on 01/19/2022 also corroborate that the facility was not operating out of ratio.

Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegations are UNSUBSTANTIATED.

An exit interview was conducted, and this report was reviewed with the Lead Teacher, Ms. Diana Martinez and a copy was provided.

Appeal rights were discussed and provided during the exit interview.

A notice of site visit was given and must remain posted for 30 days.
