On 2/9/2024, at 10:15am, Licensing Program Analysts (LPAs), Vicky Williamson and Oscar Picazo conducted an unannounced annual inspection. LPA met with Director, Amber Deluca and disclosed the purpose of the inspection. LPAs accompanied by director conducted a toured of the inside and outside of the facility. The following ratios were observed: Classroom 104 (2 year olds) had 12 children with one (1) teacher and two (2) assistants, Classroom 105 (3 year olds) had seven (7) children with one (1) assistant, Classroom 106 (3 year olds) had nine (9) children with one (1) teacher and Classroom 107 (4 year olds) had eight (8) children with one teacher. Days and hours of operation are Monday - Friday from 7:00 am to 5:30pm.

Furniture and equipment are in good condition. Toilets and hand-washing equipment are in safe and sanitary operating condition. Paper towels and toilet paper are available. The bathrooms are lighted and have ventilation. Floors in the facility are clean and safe. Solid waste storage containers have tight-fitting covers and are in good repair. All disinfectants, cleaning solutions, and other hazardous items were not inaccessible to children during the time of inspection. LPAs observed two spray containers labeled disinfectant solution on a counter in classroom 106 accessible to children. Director was reminded that disinfectants, cleaning solutions and other hazardous items should be locked and placed out of the reach of children. The playground equipment is in safe condition. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. The outdoor play area is fenced with adequate material for cushioning. Outdoor play area has canopies used for shade. The facility provides snacks. Snack menu is posted monthly. Children bring their own lunch and water bottles. Drinking water is available both indoors and outdoors. The last fire/disaster drill was conducted and documented on 1/17/2024.

The facility has carbon monoxide and smoke detectors that meet statutory requirements. The director stated there are no bodies of water on the premises. LPAs did not observe any bodies of water during the time of inspection. Director stated there are no firearms or ammunition allowed or stored on the premises.

A review of staff records on this date indicates facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. Director was reminded that all adults 18 and over living or working in the facility, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

On this date, 2/9/2024, the California Attorney General - Megan’s Law website (meganslaw.ca.gov) was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Facility maintains a ratio of one teacher supervising no more than twelve (12) children in care. Children are under supervision, including visual supervision, of a teacher at all times. At least one person trained in Pediatric CPR and First Aid is present when children are at the facility. The person who signs the child in and out of the facility shall use their full legal signature and record the time of day. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and others who can assume responsibility for the child and medical assessment. LPA reviewed a sample of staff files and observed files were incomplete. Mandated Reporter training certification for director expired on 12/6/2023. Staff 1 (S1) does not met qualifications for a teacher and was observed in classroom 105 with seven (7) children and without the supervision of a qualified teacher.

This facility is currently providing Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. LPAs advised director that prior to making construction or alterations to the facility, the director shall notify the Department of the proposed change.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, deficiencies are being cited on the attached LIC 809D.

An exit interview was conducted with Director, Amber Deluca and a copy of this report, Appeal Rights, and Notice of Site Visit were provided. Notice of Site Visit is required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. LPAs observed Notice of Site Visit posted on the bulletin board.
