This is an amended version of the report that was created on 3/22/24.

On March 22, 2024, at 9:00 AM, Licensing Program Analyst (LPA), Gloria Gonzalez conducted a complaint inspection to deliver findings and met with Director, Aimee Boiri regarding the above allegation. LPA advised Assistant Director of the purpose of the inspection and conducted a tour of the facility. There were forty-one (41) daycare children and ten (10) staff members present during the inspection.

On 1/10/24, Community Care Licensing (CCL) received a complaint alleging facility is malodorous, (the facility smelled like mold). During the course of the investigation interviews were conducted with the Licensee Representative, Director, 12 staff members, 8 daycare children, and 8 daycare parents. Licensee representative stated that there was a humidity smell reported on 1/12/24 that was also smelled outside.

This is an amended version of the report that was created on 3/22/24.

Licensee representative states there is new construction of a building behind this facility as they are excavating the ground and it had been raining on or about 1/12/24 and the smell was coming from the outside of the building.

Director stated the smell could be humidity or dampness at the time. A maintenance check was performed and found no leaks, plumbing issues, AC leaks, mildew or mold.

4 out of the 12 Staff interviewed, stated there was an odor at the facility one day during the month of January 2024, as the exact date was not known. Staff stated that it could be eggs and/or dirty diapers.

During LPA's inspections conducted on 1/19/24, 3/22/24, and 3/26/24 LPA did not smell abnormal odor or mold. Due to conflicting information obtained from the interviews and inspection conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. Therefore the allegation of the facility is malodorous is found to be unsubstantiated.

No deficiencies cited.

A copy of this report and appeal rights (LIC 9058) was provided to Director. LPA observed Director post LIC9213 – Notice of Site Visit and Director was advised this notice is to be posted for 30 days from today’s date. An exit interview was conducted with Director, Aimee Boiri.
