On 10/31/23 at 9:30 AM Licensing Program Analyst (LPA) Adrian Mangina conducted an unannounced visit for the purpose of delivering the findings regarding the above allegation. LPA met with Director, Michaelyn Rainney. Also present in the center were 25 daycare children in 3 classrooms with 3 teachers and 2 aide. Proper ratios and supervision were observed.

It was reported that facility terminated the contract of child 1 and child 2 without giving proper notice per the contract. LPA reviewed the current facility contract which stipulates a minimum two-week notice before facility can disenroll a child. Witnesses confirmed that child 1 and child 2 were terminated without two weeks’ notice in violation of their own contract. Based on the information obtained during interviews and documentation reviewed it is determined that the facility did terminate the children without proper notice.

The allegation is valid because the preponderance of the evidence has been met, therefore, the above allegation is found to be SUBSTANTIATED. See attached LIC9099D for deficiency cited.

Exit interview conducted and report was reviewed with facility representative, Michaelyn Rainney. A notice of site visit was given to facility representative and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

The licensee shall comply with all terms and conditions set forth in the admission agreement.

Facility Representative states will amend and submit to LPA admission agreement to outline instances where less than 2 week notice can be given no later than close of business 11/7/23. Staff also states will in future ensure that facility is following admission agreement terms.

On 10/31/23 at 9:30 AM Licensing Program Analyst (LPA) Adrian Mangina conducted an unannounced visit for the purpose of delivering the findings regarding the above allegations. LPA met with Director, Michaelyn Rainney. Also present in the center were 25 daycare children in 3 classrooms with3 teachers and 1 aide. Proper ratios and supervision were observed.

A complaint was received 9/7/23 alleging that staff #1 yelled at child #1 and child #2 for dumping water and food on a table. LPA conducted interviews of all pertinent individuals associated to the classroom and was unable to locate any witnesses who could corroborate the allegation. Accused staff denied yelling and children were too young to qualify during interviews.

It was alleged that staff left child in a soiled diaper for a long period of time and that the child was banging head due to the soiled diaper. LPA interviewed Director and staff who reported that a written diapering policy

requiring that diapers be changed every 90 minutes and at every transition was in place on the date of the
alleged incident. Additionally, personal rights of children regulations require that children not be disturbed
while napping. Interviews revealed that child #1 did have a soiled diaper that was discovered when child woke and was changed immediately. No witnesses were found who could corroborate that child #1 had a soiled diaper before going to sleep.

Based on the information obtained during interviews, observations, and documentation reviewed it is determined that there was no evidence found to support the claims that staff yelled at day-care children and staff left a child in a soiled diaper for a long period of time. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, therefore the above allegations are found to be Unsubstantiated.
