32 | When it comes to the allegation that Staff did not prevent day-care child from being hit and bit by other day-care children, based on interviews it was disclosed that Child #2 had been bit a few times and parent was spoken with. Staff disclosed their biting policy and stated that there are a few children in the toddler room that bite due to lack of vocabulary and they communicate with their parents as needed, but there is not a specific biter in the class. LPA Messerschmidt reviewed child's file and saw 2 ouch reports with biting incidents in the past month.
Lastly, based on record review and interviews for allegation staff did not comply with day-care children's admission agreement, it was disclosed that parents signed and initialed the enrollment packet and were provided with the parent handbook. LPA Messerschmidt reviewed Child #1 and Child #2 files and all signatures and initials were present. In interviews it was disclosed that staff have complied with all parents’ requests pertaining to children in care.
Based on the information obtained during this investigation, it has been determined that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the alleged violations did or did not occur. Therefore, the allegations are UNSUBSTANTIATED.
An exit interview was conducted, and this report was reviewed with the Director, Lina Borja, and a copy was provided. Appeal rights were discussed. A Notice of Site visit was given, and Director understands that it must remain posted for 30 days.
