On 08/30/2023 at 12:30pm, Licensing Program Analyst (LPA), Samantha Clenista conducted an unannounced case management site inspection. Upon arrival, LPA met with Center Director, Christine D’Amico. The purpose of this visit is to address the facility’s request to add a toddler option. Facility is currently licensed to care for 42 children (ages 2-5 years old) in Room 1 and Room 2. Facility is now requesting to be licensed for 12 toddlers (ages 18-36 months) in Room 1A, and 30 preschoolers (ages 2-5 years old) in Room 1B and Room 2. Fire clearance was granted on 08/14/2023. LPA toured the facility and observed a total of 10 children with three staff (2 teachers and one aide).

All indoor and outdoor activity space utilized for the children were inspected today. The areas used for the toddler program was observed to be separate from the preschool program, both indoors and outdoors. LPA informed Ms. D’Amico that the programs shall never commingle at any given time and that staff are required to always maintain direct visual supervision of the children during indoor and outdoor play.

LPA measured all indoor activity space for the toddlers and preschoolers as followed:
  • Preschool Room (1B)- 467.5 sq. ft.
  • Preschool Room (2)- 619.02 sq. ft.
  • Toddler Room (1A)- 444.02 sq. ft.


Total indoor activity space for the toddlers (18-36 months) is sufficient for 12 children, while the total indoor activity space for the preschools (ages 2-5) is sufficient for 31 children. The toddler program has one designated bathroom that consists of one toilet for potty training children and a changing table within arm’s reach of a sink. The preschool program has two designated bathrooms (one located in Room 1A that has 1 toilet, 1 urinal and 1 sink and another one in the hallway that consists of 1 toilet and 1 sink). Due to one of the preschool bathrooms being located within the toddler classroom, LPA reminded Director that all children shall be escorted to and from the bathroom and directly supervised at all times.

At no time shall the toddlers and preschoolers share the same bathroom. LPA observed bathroom signs designating which bathrooms are for which program. There is a refrigerator for children’s use in the preschool room. Director is reminded that all infant/toddler bottles shall have their name and date on them daily. Infant needs and services plan (for children who are less than 2-years-old) will be stored in the classroom in a binder per child and Director is reminded that they must be updated quarterly. LPA observed all indoor play space to be complete with age-appropriate furniture and equipment, including tables, chairs, cubbies, napping cots/mats, bookshelves, and other activity supplies for the children.

There is a separate staff restroom located in the hallway, equipped with 1 toilet and 1 sink, which is designated for children who are ill. A small area behind the teacher’s desk in Room 1A is the designated isolation area. There is an operational carbon monoxide detector on site located in between Room 1A and Room 1B. All required documents were observed posted. Sign in/out is electronic (via Procare), where each parent is assigned a pin code. Drinking water is readily accessible inside and outside the classroom via Brita filters and refillable water bottles. Director is reminded that any changes to the facility must be reported to and approved by Community Care Licensing.

The facility currently has two fenced in playgrounds, one is located directly in front of Room 1A and Room 1B, and the other is about a 195 ft. walk away from the classrooms located near the parking lot. Both areas were observed fully fenced per regulation. The area that is closest to the classrooms is designated for the toddlers which measured at approximately 1,139.06 sq. ft., sufficient for 15 children at one time. This area had lunch tables, turf and play equipment present (2 play houses and a caterpillar tunnel). There were trees and umbrellas used for shade. The playground located near the parking lot is designated for the preschool program and it measured at approximately 2,430 sq. ft., sufficient for 32 children at one time. This area had a play structure appropriate for ages 3-12 years old. Both areas have sufficient space to accommodate the requested capacity for both programs, however, Director is requesting that the toddler outdoor area be a shared space because it has lunch tables that Director would like to use for both programs to eat lunch and snacks, at staggered times. A playground waiver to share the toddler outdoor area with the preschool children at separate times shall be submitted and approved prior to licensure. LPA informed Director that children must be escorted to and from the playground at all times.

Due to the play structure located in the preschool playground being appropriate for ages 3-12 years old, Director stated she only allows the preschool children to play on the low tire swing and not climb up the structure to due to the height of it. Director stated she will ensure the children do not climb up the structure by making inaccessible via tarp and roping the entry ways off.

LPA reviewed with Ms. D’Amico the LIC 311A, Records to Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Prior to licensure, a shared playground waiver must be submitted and approved. Exit interview was conducted and report was reviewed with Ms. D’Amico. A notice of site visit was given to Ms. D’Amico and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. A license for 12 toddlers (ages 18-36 months) and 30 preschoolers (ages 2-5 years old) may be granted upon receiving the above corrections and after conducting a final file review. Ms. D’Amico stated her understanding. Ms. D’Amico understands that this report shall be kept available at the facility for public review for 3 years.
