THIS IS AN AMENDED REPORT FROM AN ORIGINAL REPORT DATED 12/02/2022.

On 12/02/2022 at 10:00am, Licensing Program Analyst (LPA) Samantha Clenista conducted an unannounced case management inspection, for Action Level Exceedance (ALE) detected in facility's water fixture. LPA met with Director, Christine D'Amico. Also present in the facility were 15 children and 5 teachers/staff. Facility was within ratio & capacity.

Per the new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.



On 11/15/2022, LPA was notified by Ms. D'Amico via email that some of their faucets at the facility had a lead exceedance. LPA received facility sketch and LIC 9275. The report indicated the facility was inspected and samples were collected on 10/26/2022.

There were 3 sink faucets that were reported with 5.5 ppb or greater lead exceedance levels as follows:


  • E- Staff Restroom sink (21.37 UG/L)- currently only used for hand washing
  • A- Children's sink in Room 1 (5.67 UG/L)- currently only used for hand washing
  • B- Children's sink in Room 1 (17.6 UG/L)- currently only used for hand washing

Director stated that the 3 faucets are mainly used for hand washing, however, has been used for water drinking via Brita filter. After receiving the test results on 11/15/22, facility immediately notified all parent/guardians of the results within 24 hours and covered all faucets with a bag and made it inaccessible until corrected. Alternatively, drinking water was/is being provided via filtered water from home and bottled waters. Facility had two extra sinks available separately for the children and staff to use while the other three sinks were not operable. On 11/18/22 and 11/21/22, facility had all 3 faucets that had Action Level exceedance replaced and has continued to follow the guidelines per PIN 21-21-CCP. Facility currently uses the 3 faucets for hand washing only, until it is re-sampled and confirmed to be below the Action Level for lead.

Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months.

Exit interview conducted and report was reviewed with the facility representative, Christine D'Amico. A copy of PIN 21-21-CCP was provided to facility today. A notice of site visit was given and must remain posted for 30 days.

Based on record review, the licensee did not comply with the directive above, as three outlets (outlet used for drinking) tested with an Action Level Exceedance (ALE). This poses an immediate Health and Safety risk to children in care.
