On 03/16/22 at 11:45 a.m., Licensing Program Analyst (LPA), Rajani Goudreau arrived at the facility to conduct a case management – licensee Initiated inspection.  Upon arrival, LPA met with licensee, Louise Kristofferso and disclosed the purpose of the inspection. LPA proceeded to tour the facility indoors and outdoors.  Facility is requesting a capacity increase of 32 children, including 23 preschool children; ages 2 through 5 years old and nine toddler children; ages 18 through 36 months. The licensee requesting an increase of the preschool capacity from 17 to 23. In addition, the facility is requesting to add additional space to the preschool classroom area and changing the children’s restroom in order to accommodate the requested capacity. The following ratios were observed: two staff members with 16 preschool children and two staff with eight toddler children.  Facility operates Monday through Friday from 7:00 a.m. to 5:30 p.m.

The total preschool indoor space measured 824.45 square feet, which is sufficient to accommodate 23 children. The licensee has agreed to lower the preschool capacity from 24 to 23 children. Updated LIC200A received at time of visit. The new preschool space was measuring during today's visit. However, the remaining indoor preschool space was previously measured on August 02, 2021.The toddler classroom was previously measured on August 02, 2021 at 345.59 square feet which is sufficient to accommodate 9 toddler children. The classrooms are equipped with age appropriate furniture, napping equipment, including cots, tables, chairs, cubbies, bookshelves, and other materials for the children use. The preschool and toddler children share a restroom located near the kitchen containing three sinks and three toilets. In addition, there is one sink for the children's use located in the preschool classroom. There is one changing table within arm’s reach of a sink in the restroom. Updated plan of operation for the shared restroom usage is needed reflecting supervision, ratio to be maintained, non-comingling of the preschool and toddler children and the changing table usage. The staff restroom is located near the preschool classroom containing two toilets and one sink and is designated for ill children, if needed. See LIC809-C continuation page…

LPA informed the licensee children shall be escorted and supervised by staff to and from the restroom and direct visual observation is required at all times. The isolation area for the preschool children is located in the preschool room and the isolation area for the toddler children located is located in the toddler room. Water is readily available for the children’s use both indoors and outdoors by the use of refillable water pitchers and cups provided by the facility. There is a carbon monoxide detector in the facility and a first aid kit with required supplies. Disinfectants, cleaning solutions, and other hazardous substances are kept inaccessible to the children in care. Required documents are posted.

The preschool outdoor activity spaced located in the back of the facility was inspected and measured a total of 1,614.07, sq feet which is sufficient to accommodate 21 children. The preschool outdoor play area decreased in square footage due to expanding the preschool indoor space. The toddler play yard located near the front of the facility was inspected and previously measured at 404.83 sq feet on August 02, 2021. There are no changes to the toddler outdoor play area. Due to insufficient outdoor space a waiver is needed for the preschool capacity increase in order to accommodate the requested capacity. The outdoor play equipment and play materials are age appropriate in the preschool and the toddler outdoor activity spaces. The surfaces of the outdoor activity spaces are maintained in safe conditions and free of hazards. There are canopies for shade in the preschool and toddler outdoor activity spaces. Proper supervision and placement of staff during outdoor activities was advised to ensure the supervision and the safety of children at all times. 

Licensee was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center.  A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Section 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform. A fire clearance for 33 preschool children; including 24 preschool children in the preschool classroom (ages 2 through 5 years) and 9 toddler children in the toddler classroom (ages 18 through 36 months old) was granted on February 10, 2022. Due to decreased capacity request an updated fire clearance will be requested by the department to reflect 32 children (including 23 preschool and 9 toddler children).

The following is pending with a due date of March 18, 2022:
  • Preschool waiver request due to limited outdoor space for the preschool children
  • Updated Toddler waiver request
  • Updated plan of operation for shared restroom use between the preschool and toddler children

There were no deficiencies issued during today's visit. The following reports were provided and discussed with the licensee: LIC809, Notice of Site Visit (LIC9213) and Appeal Rights ( LIC9058). Notice of Site visit shall be posted for 30 days from today's date. Once updated fire clearance, pending documents are received and after review and approval of the waivers, a capacity increase for 32 children shall be granted. Exit interview conducted and report was reviewed with the licensee, Louise Kristofferso.
