On 5/6/22 at 3:45 p.m., Licensing Program Analyst (LPA) Casey Gulley conducted an unannounced complaint inspection to deliver findings for the above listed allegation. LPA met with facility administrator, Hunan Arshakian and discussed the purpose for the visit. LPA toured the facility . LPA observed (15) fifteen children in care and (2) two staff at the time of visit. This agency has investigated the above listed allegation. During the investigation, LPA conducted interviews with facility director, administrator, staff, and multiple parents.

It was alleged that on April 15, 2022, Staff #2 (S2) roughly handled day care child #2 (C2) by pulling their arm and dragging them by the foot, while on the playground. S2 denied handling C2, or any other children, in a rough manner. S2 denied the allegation, explaining that C2 was redirected in a positive manner which did not involve any physical interaction. The director denied the allegation, stating that surveillance footage was reviewed and there was no significant incident observed, nor was S2 observed handling any children in a physically inappropriate manner. Staff interviewed denied observing S2 handling children roughly. Parents interviewed did not express any concerns regarding S2’s behavior. (See LIC 9099-C)

Based on conflicting information obtained during interviews and record review and no corroborating witnesses, LPA was unable to determine, whether or not, S2 handled children in a rough manner. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred therefore the allegation is Unsubstantiated.

Exit interview conducted and report was reviewed with facility administrator, Hunan Arshakian. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
