On December 6, 2022, at 10:00 am, Licensing Program Analyst (LPA), Gloria Gonzalez conducted a complaint inspection to deliver findings and met with Adminstrator, Maria Ortega regarding the above allegation. LPA advised the Administrator of the purpose of the inspection and conducted a tour of the facility. There were 34 children and 6 staff members present during the inspection.

During the course of this investigation, interviews were conducted with the Director, staff members, daycare parents, and records reviewed. On 10/24/22 LPA observed 2 rat traps with no rats in class #4. LPA did observe rat feces in the material/storage room in class #4. On 12/6/22 LPA did not observe any rat or rat feces in any of the classrooms.

Based on LPA's observations, the preponderance of evidence standard has been met therefore the allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 9099D. See 9099-C for continuation.

LPA reviewed Title 22 regulation regarding Buildings and grounds, with Administrator Ortega. A copy of this report, notice of site visit (LIC 9213), and appeal rights (LIC 9058) was provided to Ortega. LPA observed LIC9213 posted. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Administrator states the facility will continue with the monthly pest services maintenance. Administrator states the facility will maintain a cleaning protocol of daily cleaning and also deep cleaning. LPA reviewed the Building and Grounds and Infant care General

Based on LPA's observations, records review, and interviews, the Facility did not comply with the section cited above as there were rat feces found in the facility. This poses a potential health, safety or personal rights risk to persons in care.

Sanitation regulations with the Administrator. Administrator states facility will send the San Diego Regional Office a written plan of correction on the new cleaning protocol plan and proof of continued pest control services by 12/9/22.
