Day care child sustained severe head injury due to staff neglect.

On10/25/23 at 11:55 AM Licensing Program Analyst (LPA) Nancy Diaz, conducted an unannounced inspection to deliver findings on the above referenced allegation. LPA met with Victoria Dedeaux, Site Director and Freda Simmons, Area Director. Observed present today were 45 preschool children with staff Brenda Baltazar, Karla Rubalcava, Zainab Hamadi, Nadhal Daoud, Elsa Guerrero, Yohali Plascencia, Asiya Hamdi and Rajaa Janabi. Proper supervision and ratios were observed in all 3 rooms.
On July 21, 2023 a child sustained a bump on the forehead that broke the skin. According to staff who witnessed this incident, child was lined up to transition to the restroom when another child pushed him from behind, resulting to the child hitting the corner of the wall. Staff immediately applied first aid.
Throughout the course of investigation, interviews were conducted with staff members who witnessed the incident and parents of children in care. Although the above allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation of staff neglect occurred, therefore the above allegation is found to be unsubstantiated. Exit interview conducted and report was reviewed with the facility representative. A notice of site visit was given and must remain posted for 30 days.

It was alleged that the facility failed to notify day care child's parent of an incident wherein a child sustained injury to the forehead. According to staff, she attempted to contact parent via telephone. Staff stated that she did not leave a voicemail message. She however, sent both parents messages via app. (ProCare) She did not receive confirmation that either of the parents received the message.

Based on information obtained through interviews with staff and parents, record review and photos, LPA determined that the preponderance of evidence has been met. There is enough supporting information to prove the above allegation is SUBSTANTIATED, see deficiencies cited on the attached LIC 9099D.

Exit interview was conducted with site director, Victoria Dedeaux. A copy of this report, appeal rights and Notice of site visit were provided today. Observed Notice of site visit being posted. This notice shall remain posted for 30 days.
