32 | However, based on staff interviews, it has been determined that on multiple occasions between March 2020 and May 2021. Julia Dukes, Eva Handl, and Peggy Parameshwaran were observed consuming alcoholic beverages on the premises, during working hours. According to witnesses, the consumption of alcohol was confined to the director’s office. Staff interviewed did not observe staff with signs of intoxication, nor were the staff providing care and/or supervision to children. It was also noted that open alcohol beverage containers, were at no time, accessible to children. According to the facility’s Alcohol, Tobacco and Substance Abuse Policy, the unauthorized use of alcoholic beverages on the premises is prohibited. Furthermore, it is a violation of facility’s policy for anyone to engage in work for the company or to report to work in any impaired or intoxicated condition or under the influence of alcohol, drugs, or illegal substances. The policy applies to all regular employees of Kinder Mission.
Based on interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED California Code of Regulations, (Title 22, Division 12 and Chapter 1) are being sited on the attached LIC 9099D). During exit interview with facility director, LPA discussed director duties and personnel requirement regulations, which require the center director to be responsible for the operation of the center and center personnel to be competent to provide the services necessary to meet the individual needs of children in care. LPA advised director that there is the potential for staff to be unable to meet these requirements if under the influence of alcohol.
A copy of today's report, Notice of Site Visit and Appeal Rights were given to the director, Julia Dukes. An exit interview was conducted with Julia Dukes and Peggy Parameshwaran stated that at no time alcohol was consumed during business. Dukes and Parameshwaran stated that it sadden Kinder Mission Preschool a disgruntle employee would make wrong accusations with a group of ex employees. Notice of Site Visit shall be posted for 30 days from today's date. LPA observed the Julia Dukes post the notice during the inspection. |
