On 08/13/26 at 12:15 p.m., Licensing Program Analyst (LPA) Victoria Felix conducted an unannounced complaint inspection to deliver the findings regarding the above allegation. LPA met with Director, Julia Duke, advised the Director of the purpose of the inspection, and conducted a tour of the indoor and outdoor areas to gather census. The Director, nine (9) staff members, and 32 preschool children were present during the inspecton.

During the course of the investigation, interviews were conducted with the Director, several staff, several parents, and daycare children. LPA also obtained and reviewed the facility roster and other relevant documentation.

It was alleged that staff did not prevent Child #2 (C2) from engaging in inappropriate behavior toward other daycare children. The Director and staff denied the allegation and stated that staff appropriately supervise children, intervene when behaviors are observed, document incidents, and communicate behavioral concerns with parents.

The Director further stated that staff cannot intervene in incidents they do not witness.

The investigation determined that C2 exhibited ongoing behavioral concerns while in care. Documentation reviewed during the investigation reflects multiple incidents involving aggressive or inappropriate behavior, including grabbing and hitting another child on 1/23/26, engaging in rough play with peers, breaking a classmate's necklace on 3/12/26, and hitting peers on 4/20/26. Records further show that staff documented these incidents, implemented interventions when behaviors were observed, and communicated their concerns to C2's parents.

It was reported that Child #1 (C1) being hurt by C2. Staff indicated they had not observed any incidents consistent with the concerns reported. Documentation reviewed during the investigation includes an email dated 4/16/26 to C1’s parents in which the director stated that staff had not observed interactions between (C1) and C2. The majority of parents interviewed expressed satisfaction with the care provided and did not report concerns related to the alleged allegation.

Although the investigation identified evidence that C2 had a history of challenging behaviors while in care, there is insufficient evidence to establish that staff failed to supervise or prevent inappropriate interactions with other children. The available documentation demonstrates that staff intervened during observed incidents, documented behavioral concerns, and communicated those concerns to C2's parents. The investigation did not identify sufficient evidence to conclude that staff knowingly failed to intervene or prevent inappropriate behavior when they were aware of it.

Due to conflicting information obtained throughout the investigation and the absence of independent witnesses to the alleged incidents, LPA was unable to determine whether the allegation occurred. Although the allegation may have happened or may be valid, there is not a preponderance of evidence to prove that the alleged violation did or did not occur. Therefore, the allegation is determined to be UNSUBSTANTIATED.

An exit interview was conducted, and the report was reviewed with the Director, Julia Duke.
A Notice of Site Visit was provided and must remain posted for 30 days
