On 05/09/2023 at 10:10am, Licensing Program Analyst (LPA), David Miller conducted an unannounced complaint inspection to deliver the findings to the above allegations. LPA advised the Director; Jacquelyn Aguigui-Fajardo, of the inspections purpose. During the tour of the facility, there were thirteen (13) infants in care, and four (4) staff.

It was alleged that staff did not provide adequate supervision to children in care, feed children in a safe manner or distribute food to children in a sanitary manner, and staff did not wash hands between diaper changes. In addition, it was alleged that staff left a child in a soiled diaper for an extended period of time. Lastly, it was alleged that the facility changing table is in disrepair.

During the course of this investigation, interviews were conducted with the Director, staff members, daycare parents, and records reviewed.

The Director stated that the facility's infant room is adequately supervised and denied that infants are ever left unsupervised. The Director also stated that each child sleeps in their own crib and that the cribs are appropriately spaced behind the partitioned wall. The Director stated that it is policy for staff to wash their hands and wear gloves when they serve food. In addition, it is the school’s policy to not allow children to share food with each other, and if staff sees a child take food from another child's plate, staff intervene. The Director stated that it is school policy to clean the diaper changing table both before and after use. The Director further stated that staff must wash their hands and put on gloves before they change an infant's diaper. Afterward, all material goes into a bin with a lid. The Director stated that it is policy for staff to check an infant's diaper every hour, if a diaper is dirty, staff is instructed to change that diaper. She denied that any infant has been left in a dirty diaper for an extended period of time. The Director stated that they did have an older diaper changing table that was not broken or unsafe but was in need of replacement. She stated that she has since replaced this table.

Based on conflicting information obtained during the course of the investigation and no witnesses to corroborate the allegations, there is a lack of evidence available at this time to draw definitive conclusions. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are determined to be unsubstantiated. No deficiencies cited.

An exit interview was conducted, and report was reviewed with Director, Jacquelyn Aguigui-Fajardo who was provided a copy of this report along with the Appeals Rights (LIC 9098) and notice of site visit (LIC 9213). The notice of site visit must remain posted for 30 days. LPA observed the form LIC 9213 posted on the front lobby parent board.
