On 7/26/23 at 3:00pm, Licensing Program Analysts (LPAs), Martha Malane and Vicky Williamson conducted a case management inspection for the purpose of a capacity increase and to add a toddler component to the preschool license. Upon arrival, LPAs met with Licensee, Laura Valdez-Oropeza and were led on a tour of the facility. The facility is requesting a capacity of 60 preschool children (age 2-5 years) in rooms 1, 2, 3 and 5 and 12 toddler children (age 18-36 months) in room 4. Operating hours are Monday through Friday from 7:00am to 5:00pm. There were 23 children and four (4) staff members present.

Classroom 4 was inspected and measured a total of 421.15 square feet, which is sufficient to accommodate 12 toddler children. Classroom 4 was observed to be equipped with cots for napping, cubbies, bookshelves and other materials for the children use. There is a restroom between rooms 3 and 4 with two (2) toilets and two (2) sinks. Licensee stated she will submit a plan of operation for toddler children in room 4 to share the restroom with preschool children in room 3. There is a changing table within arm's reach of a sink in room 3. Licensee stated she understood that the sink is to not be used for food preparation.

The outdoor activity space for toddler children was inspected and previously measured a total of 879.45 square feet which is sufficient to accommodate 11 children at one time. Licensee stated she will submit an updated 200A to reflect a capacity of 11 children. The outdoor play area is fenced and includes outdoor play equipment that is age appropriate. There is no high climbing equipment. Shade is provided by the use of canopies and building awnings. Proper supervision and placement of staff during outdoor activities was advised to ensure the supervision and the safety of children during outdoor play.

A fire clearance for 60 preschool children (age 2-5 years) in rooms 1, 2, 3 and 5 and 12 toddler children (age 18-36 months) in room 4 was granted 7/18/23.

At 3:07pm LPAs observed Child 1 (C1), who is 6 years old, and Child 2 (C2), who is 15 years in room 2 with preschool children. The facility is currently licensed for preschool children age 2-5 years; see LIC809D for deficiency cited as licensee is operating beyond the conditions and limitations specified on the license.

LPA informed Licensee, Laura Valdez-Oropeza that this report dated 7/26/23 documents one (1) Type A citation on the attached LIC809-D, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed licensee to provide a copy of this licensing report dated 7/26/23 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or other written statement, must be placed in the child's file for verification.

The following is required:
1. Plan of operation for toddlers and preschool children to share the restroom between rooms 3 and 4
2. Updated LIC200A to reflect a decrease in the requested capacity
3. Proof of room 4 set up for children

Exit interview conducted with Licensee, Laura Valdez-Oropeza. Notice of Site Visit shall be posted for 30 days from today's date. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

A license for 60 preschool children (age 2-5 years) in rooms 1, 2, 3 and 5 and 11 toddler children (age 18-36 months) in room 4 may be granted after required documents are submitted and approved and a final file review.

LIcensee stated that C1 and C2 will not return to the facility during operating hours. LIcensee stated she will re-take the application orientation and review Title 22 regulations.

Based on observation and interview the licensee did not comply with the section cited above in that (C1), 6 years old, and (C2), 15 years were observed in room 2 with preschool children. This poses an immediate health, safety and personal rights risk to persons in care.
