25 | On 7/2/2024, at approximately 10:00AM, Licensing Program Analyst (LPA) Jonathan Tse conducted an unannounced case management visit at the facility. LPA met with Site Supervisor, Naomi Miura (D1). Present during the visit was D1, six staff and 23 preschool-age children.
Based on LPA's record review and interview, there was a staff member (S1) present in the facility who was not associated to the facility. LPA discussed fingerprint clearance and association requirements with D1. During the visit, LPA found that S1 did have a valid fingerprint clearance and was able to associate them to the facility. LPA informed D1 that a Type A deficiency shall be cited today, in addition to a civil penalty. D1 stated that they understood.
LPA inspected the outdoor play area of the facility and found that it is equipped with resilient padding and cushioning. LPA observed that the facility uses blocks from Community Playthings. Based on file review of the user guide for the blocks, they are intended for use by children ages three and up. Based on LPA's record review, LPA confirmed that a child under the age of three had access to and was playing with the blocks. The child sustained an injury as a result. LPA informed D1 that a deficiency shall be cited for play equipment not being age-appropriate for children in care. D1 stated that they understood.
Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
