On June 17, 2024, Licensing Program Analyst (LPA) Van conducted an unannounced inspection to finalize this complaint and deliver the findings to the Center. LPA met with the infant/toddler Assistant Director, Tunisia Kemp. LPA was informed that the site Director and the preschool Assistant Director are on vacation. The purpose of the inspection was explained, and entry to the Center was granted. Today, 6 staff members supervised 33 children, meeting the teachers-to-children ratio.

During the investigation, the LPA interviewed children and teachers, reviewed medical records, and obtained police reports. Based on the gathered information, it was determined that the staff had failed to provide adequate supervision, leading to an inappropriate interaction between C1 and C2 in the wooden playhouse during outdoor play. It was also uncovered that the children's personal rights were violated when staff used inappropriate language while instructing them to lie down during nap time.

Based on information gathered through interviews and evidence obtained, the preponderance of evidence standards has been met. Therefore, the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC9099D.

A notice of site visit was given and must remain posted for 30 days.

Exit interview was conducted, and the report was reviewed with the Assistant Director, Tunisia Kemp.

Throughout the investigation, LPA conducted interviews with children and teachers, thoroughly reviewed medical records, and acquired police reports. Based on the gathered information, it was determined that there was insufficient evidence to support the claim that the staff had not treated all childcare children equally. Furthermore, there was also insufficient evidence to substantiate the claim that the staff had not prevented a child from waking up a napping child.

The Department has investigated the above allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. Therefore, the allegations are Unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.

The center will provide a supervision plan that encompasses staff scheduling, ensuring proper placement of staff on the playground, and offering training and mentorship to support the staff working with the enrolled children. All training materials and signed attendance records of the staff who participated will be submitted to the LPA by the due date.

Based on interviews and a review of records, the center did not comply with the section cited above. The staff failed to provide adequate supervision, which led to an inappropriate interaction between C1 and C2 in the wooden playhouse during outdoor play. Not providing adequate supervision to meet the needs of the children in care presents potential health and safety risks to them.

Between June 3 and June 6, 2024, the center conducted thorough training on children's personal rights for all staff members. The training materials and signed attendance confirmations from the teachers have been submitted to the Licensing office. As a result, the deficiency cited today is cleared.

Based on the interview, it was found that the Center did not comply with the section cited above in that staff member used inappropriate language when instructing children to lie down during nap time. This violation poses a potential health and safety risk to the children in care.
