On March 5, 2025, at 10:00 AM, Licensing Program Managers (LPMs) Leung, Zebila, and Licensing Program Analysts (LPAs) Van, Naves, Tso, Alvarado, and Wadhwa met with licensees Xu Ming Chen (Michelle) and Yan Yu Zhao in an informal office meeting. The purpose of the informal meeting was to address the licensee's history of non-compliance, review provisions regarding temporary absences, and discuss regulations concerning safe sleep practices for infants.

During the meeting, the following was reviewed and discussed:

· On November 20, 2023, a complaint was substantiated: the licensee's failure to comply with the infant sleep regulation. Specifically, an infant was found napping in a room with the door closed.
· On November 25, 2024, LPA Alvarado inspected the You and Me Children Center and found that Xu Ming Chen was present from 10:25 a.m. until 4:30 p.m. This duration indicated that Ms. Chen's temporary absences exceeded the permissible limit of 20 percent for her family childcare home licensee 384002205. (You and Me Children Center's infant license is 414004856, and the preschool license is 414004795, which Xu Ming Chen is co-owner of.)
· On January 23, 2025, during the annual inspection, it was noted that 2 out of 4 infants were swaddled during nap time. One crib contained a sleeping child with a blanket, a pillow, and books inside. Blankets were used as bedsheets to cover both cribs.

· During multiple inspections, the licensee was absent from her childcare home for over 20 percent of its operating hours.
o This was particularly noted during an annual inspection on January 23, 2025, where Ms. Chen was away from her family childcare home from 9:15 a.m. to 2:30 p.m. Ms. Chen was at her You and Me Center when LPAs Alvarado and Tso conducted an unannounced inspection. After being notified by her childcare home staff about the Licensing visit, Ms. Chen left the center and returned to her family's childcare home.
o On February 10, 2025, a plan of correction and a case management inspection regarding a temporary absence was conducted. The licensee was not at home upon arrival. The licensee returned around 2:13 PM.
o On separate inspections dated 7/22/2022, 11/20/2023, and 1/9/2024, the licensee was absent upon LPA entering the home and only returned during the visit.

The licensee was reminded of the following:
· The Licensee should be the primary provider for the licensed family childcare home.
· Inspection Authority of the department. The licensee must review with staff to allow Department personnel to enter the home upon showing their state-issued badges.
· If the Licensee must be temporarily absent from the facility, it is important to notify the department and families of currently enrolled children before the absence.
· Should the Licensee's temporary absence exceed 20% of the operational hours within a given day, the department must be informed, and prior approval must be obtained.
· Temporary absence must not be outside employment that interferes with the daycare operation.

· The licensee must adhere to all safe sleep regulations. The licensee must ensure the safety of infants during designated nap times. This responsibility includes keeping the nap room door open while infants sleep and removing all sleeping sacks.
· Licensee must review and conduct a training session for staff members regarding safe sleep practices for infants. Staff must understand that swaddling infants is not allowed. The bedsheets must fit the mattresses, and blankets should not serve as bedsheets.
· The licensee must be truthful with families and Licensing personnel or representatives.
· The Licensee should keep up to date with and adhere to all the rules and regulations established by the department.

Licensee must understand the importance of adhering to all licensing regulations. The Department will conduct additional visits to this facility to confirm compliance with these regulations.

An exit interview was conducted, and the report was reviewed with the licensee, Xu Ming Chen (Michelle).
