On 3/13/2024, at approximately 10:10AM, Licensing Program Analyst (LPA) Jonathan Tse and Licensing Program Manager (LPM) Ali Zebila conducted an unannounced annual visit at the facility. LPA and LPM were granted entry to the facility by Director, Carmen Lin (D1). Present during the visit were the Director, five staff members, and 29 preschool age children. The facility is in compliance with staffing ratio and capacity requirements on this day. The facility operates as a Mandarin-immersion program.

LPA inspected the facility for any health and safety hazards. LPA observed the facility to be in clean and orderly condition. Children are signed in at the front door of the facility. There are three fully charged fire extinguishers present in the facility. There are smoke and carbon monoxide detectors installed in the facility. Electrical outlets were observed to be covered or obstructed by furniture to be inaccessible to children in care.

LPA observed cubbies to be available for each child in care. There are age-appropriate toys and learning materials present in the facility. There are cots available for each child to use for napping. Children provide blankets and bedding from home and take them back once a week for cleaning. LPA observed water bottles to be present for each child present during the visit. D1 stated that children bring water bottles from home and the facility provides drinking water for them. There are three sinks and three toilets available for children to use. There is a diaper changing station that is within hand’s reach of a handwashing sink. The facility provides lunch for children from Tuesday to Friday, in addition to daily snacks. Children bring lunch from home on Mondays. Poisons, cleaning detergents, and other chemicals are stored inaccessible to children. Per D1, there are no firearms or weapons in the facility.

LPA observed the outdoor play area to be free of debris and other loose articles. The facility was granted a waiver for rotational use of the outdoor play area for up to 28 children at a time only. During the visit, LPA did not observe any children using the outdoor play area. LPA observed teachers taking children out of the facility. D1 stated that children are taken to nearby parks or playgrounds that are in a walkable distance for outdoor play in the mornings. Per D1, the outdoor play area is used in the afternoons. There are no pools or other bodies of water present in the facility.

LPA reviewed facility files, staff files, and children’s files. There is at least one staff member present with current First Aid/CPR training. All staff present have completed and maintained current Mandated Reporter Training.

At 11:20AM, LPA observed that S6 did not have fingerprint clearance. Based on record review, LPA confirmed that S6 did not fully complete the fingerprint clearance process. LPA informed D1 that a Type-A deficiency and a civil penalty of $500 will be issued today for having an individual present without fingerprint clearance.

LPA observed all children’s files to be complete. The facility license, Emergency Disaster Plan (LIC610), Notification of Parents’ Rights (PUB393), and Personal Rights (LIC613A) were observed to be posted and accessible for review. LPA advised that updated forms should be posted in addition to lead testing results for the facility’s fixtures.

D1 was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a
maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.
LPA referred D1 to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. For IMS information see PIN 22-02-CCP. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice) or (800) 514-0383 (TTY) and link to publication. D1 was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
See LIC809-D for deficiency cited today regarding fingerprint clearance requirements. See LIC9102-TV for technical violation issued today regarding maintenance of staff transcripts. See LIC9102-TA for technical assistance given regarding placement of medication.

Appeal rights were provided and explained to D1. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Director, Carmen Lin.

LPA Tse informed Director Carmen Lin that this report dated 3/13/2024 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Tse informed D1 to provide a copy of this licensing report dated 3/13/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

The facility shall have S6 fingerprinted. LPA notified D1 that S6 shall not return to work until they have acquired fingerprint clearance. During the visit, S6 was taken to a LiveScan vendor to start the fingerprint process again. LPA received a completed copy of the LiveScan receipt. This deficiency shall be cited and cleared the same day of the visit, 3/13/2024.
