On June 22, 2023 t 11:30 AM, Licensing Program Analyst (LPA) met with site director, Laysan Andrews, for an unannounced subsequent complaint inspection. The purpose of inspection was explained. Present in the facility is director and 2 staff caring for 12 children.
In today’s inspection, LPA along with licensee inspected for health and safety hazards. LPA observed no deficiencies during inspection.
During the course of investigation, LPA interviewed director and staff. It has been determined that when using bathrooms in the gym, staff was not able to fully monitor children in the bathroom as staff waited by the bathroom door.

Based on LPA’s interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is founded to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division & Chapter number), are being cited on the attached LIC 9099D.

(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Site director agrees to train staff on bathroom protocol for children in care by June 29, 2023. Director will email LPA the meeting agenda and include the signatures of all staff in attendance.

Based on interviews, staff were not able to visibly see day care children while children were in bathrooms as staff waited by the door. This is a potential risk to children in care.

In today’s inspection, LPA along with licensee inspected for health and safety hazards. LPA observed no deficiencies during inspection. LPA observed that children had an adequate amount of snack during inspection. Staff states that children receive additional snacks if children are still hungry. LPA observed that children's items were properly labeled and stored, and LPA observed proper ratios.

During the course of investigation, LPA interviewed director and staff, and LPA reviewed facility records. LPA reviewed 5 staff's files and 5 children's files. Facility files were complete with all required Licensing documents. LPA observed that all teachers had qualifications on file.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
