25 | Licensing Program Analyst (LPA) Van conducted a case management inspection today in response to an unusual incident report received by the Department on August 1, 2023, in conjunction with case management regarding the Action Level Exceedance (ALE) of Lead at the Center. A separate case management report is created for the Action Level Exceedance (ALE). LPA met with site Director Yarena Ozuna. Today, the Center has nine teachers supervising 26 children. Among the 26 children, 11 are infants and 15 are toddlers.
The incident that occurred on July 31, 2023, involved a child's personal rights. A Center video footage showed a staff member (S1) pulling the child’s arm toward S1 to get the child to follow instructions. In today’s inspection, video footage of the incident was obtained and reviewed. The footage was consistent with what the facility Director had reported.
Following the incident, the facility reported the incident to the Licensing Department promptly. The Director took immediate action by conducting a staff meeting/training to discuss policies and procedures for providing care to children with dignity and respect. The meeting was conducted on August 4, 2023. Director also stated that the staff member involved in the incident was terminated from the position.
As a result, the following Title 22, Division 12, Chapter 1 deficiency of the California Code of Regulations (CCR) is being cited on the next page.
An exit interview was conducted and Plans of Corrections (POC) were developed and reviewed with the Site Director. A copy of this report and appeal rights were discussed and left with the Site Director, whose signature on this form confirms receipt of these reports. Notice to be remain posted for 30 days.
