Licensing Program Analyst (LPA), Mok, conducted an unannounced inspection to finalize this complaint today. LPA met with the Site Director, Kristina Langner, and explained the purpose of the Inspection to her. There were 30 children with 14 staff present. Based on the interviews conducted and the relevant documents gathered by CCL, there was a sufficient evidance to prove an unqualified staff who hasn't earned any E.C.E. until the end of December 2022 providing care & supervision to children with a lead teacher in a class, staff handled a daycare child roughly while in care; a particular Staff was terminated by the faclity after the incident.

Based on the interviews conductned and the relevant documents gathered, the preponderance of evidence standard has been met. Therefore, the above allegations were found to be SUBSTANTIATED. California Code of Regulations (Title 22, Division 12 & Chapter 3) are being cited on the attached LIC 9099D.

The licensee provided the training to all Staff after the incident. LPA obtained the training material and a list of the Staff who completed the Positive Guidance at Bright Horizons training from the licensee. This deficiency was cleared during the Inspection.

This requirement was not met as evidenced by based upon interviews. A staff handled a daycare child roughly while in care; the facility terminated the staff after the incident. This poses a potential health risk to children in care.

(c) To be a fully qualified teacher, a teacher shall have one of the following:(1) Twelve post-secondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university; and at least six months of work experience in a licensed child care center or comparable group child care program.

The licensee replaced a qualified teacher who has 12 E.C.E. units in the class until a particular staff earns the required E.C.E. units. This deficiency was cleared during the inspection.

Based on the interviews conducted, there was no sufficient evidence to prove the facility was out of ratio due to short staff and staff forced children to eat while in care.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur. Therefore, the allegation is Unsubstantiated.”
