On April 23, 2024, Licensing Program Analyst (LPA) Van met with Director Luisa Baj for an unannounced required random inspection. The purpose of the inspection was explained, and the Director granted LPA entry to the facility. The center is a combination center, an infant with a toddler component, and a preschool program. Both programs operate under a separate license. Two infant-qualified teachers and six aides supervise 18 children (11 are infants and 7 are toddlers).

The infant/toddler program operates on a large open floor partitioned into three pods. The toddler option room is physically separate from the enclosed infant areas.

According to the criminal records clearance verified through the CDSS Guardian Background check site, it was discovered that one of the staff members who was present during the inspection was not associated with the Center or did not have a criminal record clearance.

LPA and the Director thoroughly examined the physical plant to identify potential health and safety hazards. The center has electronic sign-in and sign-out. Parents are provided a unique pin when signing in/out. Upon review, the record showed that all parents' signing in&out matched and accounted for the number of children present. The infants' classrooms were clean and organized, with appropriate heating, lighting, and ventilation. The Center provides age-appropriate toys, furnishings, changing tables, and equipment. LPA did not observe any pools, spas, or other bodies of water, nor did they notice any bouncers, exersaucers, or similar equipment at the facility.

Based on observation, interview, and review of the record, the Center did comply with the section cited. One of the employees, S1, has worked at the Center since July 2023 and failed to transfer their criminal record clearances to the facility. The presence of an adult working at home without a criminal record and child abuse clearances presents immediate health and safety risks to the children in care.

To meet this requirement, the Director may need to rearrange or schedule the teacher as necessary. According to the Director, no firearms or weapons are present at the Center, and all cleaning materials and potentially hazardous objects are kept out of reach of children. Personnel restrooms are separate from children; all solid waste storage containers have tightly fitted lids. The Center centralized smoke and carbon monoxide detectors, multiple fully-equipped fire extinguishers, and a First Aid kit. Designated cubbies are available for children to store their belongings.

There is a designated area where infants can rest or nap without being distracted or disturbed. The area is equipped with sufficient sleeping equipment and cots for each child, and all mats and bedding are stored in their appropriate location. LPA reminded the Director that emergency exits must always remain clear, and that cots and cribs cannot be placed in a manner that obstructs emergency exits.

LPA observed that one of the cribs had a loosely fitted bedsheet. The Director promptly replaced it with a tight-fitting one. LPA then emphasized the importance of safe sleeping practices for infants and informed the Director that the mattresses and crib padding must have snug-fitting bedsheets to prevent the risk of choking or suffocation while the infant is sleeping.

LPA observed that one of the infant classrooms had no qualified teacher present. The teacher who was in the classroom holds ECE units, which qualify them as preschool teachers; however, they lack the infant/toddler units. Furthermore, the other two staff members present in the classroom also lack ECE units.

Per Director, the Center provides disposable diapers and wipes for infants. There were three changing tables observed. The changing tables were observed to be equipped with at least 1" thick padding and covered with disposable paper. Additionally, the changing tables are designed with at least 3" elevated edges to prevent accidents. These tables are located within arm's reach of the sink, and disposable wipes are used to clean the area after each use. The Director has been reminded that the diaper changing area and sink must be reserved for their intended use only. They mustn't be used for food preparation or as a counter to store classroom activities or teacher resources.

Parents provide bottles, nipples, and other food service items for their infants, and the staff ensures that these items are sent home with the infants each day. The food provided by parents is stored appropriately in the refrigerator and labeled accordingly. Medications intended for infants are stored in the infant classroom backpack.

The facility presently has an outside waiver that allows eight children to utilize the outdoors simultaneously, and a rotating schedule is necessary. The outdoor surface area appears to be well-maintained and in good condition. It's covered with padding underneath, making it safe and comfortable for infants to play on. Drinking water is also easily accessible outside through pitchers, cups, or bottles.

LPA checked the personnel and children's records at the facility. A sample of children's files contained complete information such as medical assessments, needs, services, feeding plans, and signed admission agreements.

The staff files were well-organized and thorough, with proof of educational credentials. Multiple staff members were observed to have valid CPR cards and vaccine proofs for Measles, Pertussis, and Influenza in their files. Additionally, the facility had posted the required documents, including the license, menus, waivers, Notification of Parental Rights, Notification of Personal Rights, Car Seat Law, and Emergency Disaster Plan. The Director stated that fire and earthquake drills are conducted monthly, with the most recent fire drill being held on March 25, 2024.

The Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) policy was discussed. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The Director was informed about Mandated Reporter training AB 1207. The Mandated Reporter AB 1207 training must be completed every two years by the Licensee and for all staff hired. The Director was informed of the MyChildCarePlan.org website, a consumer education website that helps families obtain child care by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for
drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

CCC DID NOT COMPLETE TESTING PRIOR TO THEIR DEADLINE.

Water lead testing was completed on 8/24/2023, which was after the due date of January 1, 2023. The deficiency was issued and has since cleared.

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.
