On February 15, 2024., Licensing Program Analyst (LPA) Van conducted an unannounced Plan of Correction (POC) inspection. One of the staff members, Jin Song (Annie), greeted LPA. The purpose of the inspection was explained, and the staff granted LPA entry to the Center. Jin Song informed LPA that a group of twelve children went to the park under the Director's supervision. Jin Song told LPA that she was not the person in charge. At the Center, three teachers were supervising 13 children, and two more children were dropped off, bringing the total to 27. During the inspection, Sally Chen, one of the teachers present, took four children from the Center to an undisclosed location, which Jin Song refused to reveal to LPA. The Director, LayLay Eung, and two teachers returned with 12 children during the visit.

During the visit, it was noticed that the three teachers present at the Center had confirmed that they were not assigned as the person in charge or appointed as a substitute childcare center Director. As a result, no one was in charge of the Center while the Center Director was absent. Although the three teachers were not familiar with the Center's operations, they were left alone at the Center.

On the January 10, 2024, annual inspection, the Center was found to have multiple deficiencies. These included water fixtures that were not tested for lead after the due date of January 1, 2023, and three teachers were missing immunization records. During today's inspection, LPA thoroughly reviewed all personnel records, including those of the three teachers who were missing immunization records.

Based on the records review, it was found that all personnel records have complete immunization records. The water lead testing has been completed, all documents were submitted to the Licensing office, and the result has been uploaded to the Water Board. All deficiencies cited during the January 10, 2024, inspection have been cleared today.

See LIC 809D for deficiencies cited during today's inspection.

An exit interview was conducted with the Director, and a consultation was provided. Director Laylay Eung read and signed the report. Today's report and notice of the site were provided to the Director. The Director is advised to provide a copy of the Evaluation Report and the Type "A" Deficiency cited to the parents and guardians of children currently enrolled in care and parents of newly enrolled children during the next 12 months. A signed and dated LIC 9224 shall be maintained in all Children's files. LPA informed the Director that a site visit notification must be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

The Center must adhere to its Licensed limitations and requirements. The Director must reduce the number of children to meet the total capacity of 24 and provide Licensing with a written plan, training, and schedule to comply with the license limitation by February 15, 2024. The written plan must include no comingling with children from the Family Child Home located behind the Center. A written plan and schedule will be sent to LPA.

Based on observation and interview, the Center did not comply with the section cited above in that the Center had 27 children present today. The Center did not follow its licensed limitations of 24 capacity, which poses immediate health, safety, or personal rights risks to children in care.

101215.1 Child Care Center Directors Qualifications and Duties. (f) When the child care center director is absent from the center, arrangements shall be made for a fully qualified teacher as specified in Section 101216.1(c) to act as substitute. This substitute child care center director shall be aware of center operations, including total enrollment; shall be trained in program operation; and shall be designated as an authorized person to correct operational deficiencies that constitute immediate threats to children's health and safety.

The center director must ensure that there is a qualified teacher who can take over as the substitute director when she is not present. The substitute director must be informed of their role and be familiar with the center's operations. By February 29, 2024, the Center will submit a "Designation of Administrative Responsibility" form LIC 308 to the Licensing office.

Based on observation and interview, the Center did not comply with the abovementioned section. The Center did not assign a person in charge or appoint a substitute childcare center Director when the Director was absent. Each of the teachers who were present upon LPA entrance to the Center confirmed that they were not assigned as a substitute director or in charge of the Center, which poses a potential health and safety risk to children in care.
