On November 26, 2024, Licensing Program Analyst (LPA) Corina Beckby met with Applicant (A1) Porscha Gulley for the purpose of a pre-licensing and change of location inspection. LPA provided the Entrance Checklist to A1 and reviewed the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. Fire Inspection Clearance was granted on 10/30/24 by The Tracy Fire Department County Fire Authority Community Risk Reduction for a total capacity of 14 children.

Applicant and all adults living in the home have criminal background clearance and was verified by LPA accessing Guardian. A1’s tentative hours of care are 7 days a week 23 hours a day.



Because A1 rents the home, proof of landlord notification is required. LPA observed the Property Owner/Landlord Notification form (LIC9151) that the applicant confirms the form was provided to the property owner/landlord. A1 has not obtained a signed Property Owner/Landlord Consent form (LIC9149). Without this consent, the applicant understands that, once licensed, they can operate with a maximum capacity of 12 children. If property owner/landlord consent is obtained in the future, the applicant is advised that a new Application for a Family Child Care Home License (LIC 279) must be submitted with a change of capacity fee of $25, to increase the capacity and provide care to 14 children.

A health and safety inspection were conducted inside and outside of the FCCH. A1 accompanied LPA for the entirety of the tour. The FCCH is a two story home with 5 bedrooms, 3 bathrooms, family room, dining room 1 &2, sitting room, kitchen, laundry room, hall closet and garage. The OFF-limit areas are second floor, garage, downstairs bedroom, all closets, right side of back yard, shed and front yard.

A1 understands that OFF-limit areas must remain inaccessible to children in care. A1 understands if she wants to make any OFF-limit area an ON-limit area, she must notify Licensing and LPA must do an inspection BEFORE children are allowed in said area. Functioning smoke and carbon monoxide detectors were observed and tested. A 2A10BC fire extinguisher and 2 first aid were observed. Safety latches are in use on some kitchen and bathroom cabinets. The applicant understands that she must ensure the safety latches are not broken. LPA discussed with the applicant that if there are any poisons at the home, all poisons must be locked with a key lock or combination lock. A1 stated there are no firearms. The fireplace has tempered glass and will not be used during working hours. LPA verified that toxic and hazardous items were inaccessible to children in care. There are no bodies of water on the premises.

LPA discussed Mandated Reporter Training with A1. Health and Safety Code 1596.8662 requires all licensed providers, applicants, directors and employees to complete training as specified on their Mandated Reporter duties and to renew their training every two years. Volunteers are encouraged but not required to take the training. This training requirement may be met by using the Department’s Office of Child Abuse Prevention (OCAP) online training modules. The OCAP modules are free of cost and available at: http://www.mandatedreporterca.com/. The training is currently provided in English and Spanish. Mandated Reporter certificate expires on 02/18/25. Current Pediatric CPR and First Aid training was verified and expires on 12/02/25. Completion of Preventative Health and Safety training including nutrition and lead exposure was verified before the inspection. Proof of required immunizations for A1.

LPA discussed the Safe Sleep Regulations with A1 and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed A1 of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA discussed the requirement to check and log infant napping every 15 minutes for infants under 24 months. LPA provided a copy of the LIC 9227, Individual Sleeping Plan, to be completed for infants under 12 months.

A1 was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

A1 understands licenses are not transferable, and once licensed, Licensee must live in the home and be present for 80% of the operating hours. Applicant understands that licenses are not transferable, and once licensed. LPA explained to applicant that if she relocates and wants to continue to provide care, she must submit a change of location application and have the new home inspected.



Type A/B citations and Immediate Civil Penalty regulation deficiencies were reviewed. LPA reminded A1 to advise the department of any and all facility closures (vacations, holidays, and illness). A1 understands if an unusual incident occurs; Licensing is to be notified via phone call, e-mail or fax within 24 hours and the Unusual Incident Report (LIC 624) shall be submitted within 7 days to remain in compliance. A1 understands that if any structural changes are made to the FCCH; Licensing must be notified PRIOR to construction.

A1 understands annual licensing fees are due on the anniversary of receiving license. The annual fee for a large FCCH is $140.00 per year. A late fee is assessed the day after the anniversary date.

A1 understands that children’s and staff records are to be maintained according to Title 22 regulations and be accessible to Licensing for up to 3 years. LIC 311D, records, postings, reporting requirements were reviewed. A1understands that a current roster must be maintained and that disaster drills must be conducted and documented once every six months. LPA discussed supervision, personal rights, criminal record clearances, staffing ratios and capacity, and maintaining buildings and grounds.

A1 was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

On this date, 10/01/2024, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. A1 stated she understood all the information that was discussed and reviewed.

Effective today 11/26/2024, Porscha Gulley will be approved for a Large Family Child Care Home license for a MAX. CAP (WHEN THERE IS AN ASSISTANT PRESENT): 12 - NO MORE THAN 4 INFANTS. LICENSEE UNDERSTANDS THAT WHEN ASSISTANT IS NOT PRESENT, THE CAPACITY REVERTS TO A SMALL FAMILY CHILD CARE HOME.



An exit interview was conducted, and the report was reviewed with Porscha Gulley, to keep on file at the facility.
