Enforcement Analyst (EA), Yolanda Hankerson with the Home Care Services Branch (HCSB) conducted an
on-site inspection for the purpose of a complaint investigation. EAHankerson arrived at the business address
for ACCESS SENIOR HOMECARE, INC., and was greeted by the Licensee Preston Miller. The analyst
explained that he was there to conduct a complaint investigation regarding the above allegation and listed
documents that will need to be made available in order to complete the investigation. The requested
documents included training plan for new hires, training course material, statements from staff, and various
personnel records. The evidence obtained demonstrated that medical service are being done by HCO staff
which exceeds licensing authority. Based on Analyst’s observations, interview, and evidence collected, the
preponderance of evidence standard has been met, therefore, the above allegations are found to be
SUBSTANTIATED. Health and Safety Code, Division 2, Chapter 13, Article 1, Section 1796.12(n) is being citedon the attached HCS 9099D report. Analyst Hankerson concluded the visit with an exit interview and provided a copy of the HCS 9099 and 9099D investigation reports along with appeal rights.

Licensee has stated that their Home Care Organization (HCO) will discontinue the administration of medication to all clients. Any clients who do not have the means to manage their own medication must be directed by the HCO to seek assistance from friends/family members or solicit this service... from a licensed health care professional.

This subdivision shall not authorize a registered home care aide to assist with medical services that the client self-administers that would otherwise require administration or oversight by a licensed health care professional.

The Home Care Organization (HCO) will provide to the Department, within seven days, confirmation that all staff have received supplemental training which includes the topic of services permitted by law under the HCO License. In addition to training, the HCO will provide the Department with signed declarations from all employees stating that they understand that the administering of medication to clients is not permitted under the HCO’s current license. Additionally, the HCO agrees to maintain the same documentation for all future employees and rehired employees.
