On 07/15/2021, at approximately 10 AM, Licensing Program Analyst (LPA) Chad Cabigon delivered the findings for this complaint investigation. LPA met with Jasmine Becerra, Social Worker, and the complaint report was discussed.

Prior to opening the investigation, LPA reviewed the FFA’s (Foster Family Agency) file including the particular Resource Home’s history of relevant Incident Reports, Complaints, and Deficiencies. The following records were obtained from the FFA: the children’s Needs & Services Plans (Quarterly Reports), Child & Family Team (CFT) Meeting notes from 01/26/2021, the Resource Home’s Certificate of Approval, its SAFE Home Study, the Family’s placement history, and the Resource Parents’ training records. Interviews were conducted with the following individuals: the children (C1 and C2), the Resource Mother (RM), a mental health clinician, the FFA Social Worker (SW), and the case-carrying County Social Worker (CM).

It is documented in the Needs & Services Plan for C1, as a method for meeting the case plan’s objective, that C1 is to “receive a consequence for hitting other children, or adults.” It is also documented that non-compliance is an identified and ongoing problem area for C1. Between the Needs & Services Plan and CFT Meeting Notes, there is enough indication that C1’s Team was aware of the consequences that C1 received and the disciplining that RM utilized—that is, there is no documented counter-direction or corrective instruction from CM or any of C1’s therapists for RM to reduce the length or severity of the consequences for C1’s bad behavior. It should be noted that the consequence is merely the taking away of TV-watching privileges, and as part of managing C1’s behaviors and as a way to encourage C1 to exhibit good behavior, the length of time for the consequences can be reduced via C1 simply being compliant in any number of ways throughout the day. In response to this LPA’s question of whether or not they felt the punishment or consequences were too harsh, C1 and C2 stated that the “grounding” was fair or “okay.” CM stated that she does not know if there could be a better Home or situation for the kids. CM also expressed that although she can see how the punishment or consequences could be perceived as excessive, she was sympathetic with the difficulty of the situation considering the level of care the children need and recognized that implementing structure by way of disciplining was needed.

Based on LPA’s interviews and records reviewed, the preponderance of evidence standard has not been met; therefore, the allegation is Unsubstantiated—although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

No Interim Licensing Standards or Title 22 Regulations were cited during today’s inspection. Exit interview conducted and a copy of this report is being provided to the FFA.
